As the charge was admitted it was found to be proved.

The committee then had a brief discussion with Mr Hannam as to what matters are taken into account when reaching a penalty for careless riding.

Penalty:

Mr Hannam’s Jockey’s License was suspended from the conclusion of racing on 17 July up to and including racing on 6 August 2016 (12 days). The committee when fixing quantum of penalty, was aware that three premier race days were scheduled within the period of suspension.

Facts:

Following the running of R1 (Dairymaster /Eltham Veterinary Services Maiden 1200), Information No. A7674 was filed with the Judicial Committee. It was alleged that Jockey Mr Hannam permitted his mount ART DECO to shift ground inwards when not clear of GERONIMO near the 1000m, causing rider T Johnson to be dislodged.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be ........careless.

Mr Hannam acknowledged that he understood the Rule and confirmed to the committee that he admitted the breach.

Another Information was received by the committee, with regard to another careless riding charge preferred against Mr Hannam in the same race. Due to both incidents occurring in close proximity, it was agreed by all parties that the Informations would be heard together. With the committee to then retire to consider the matter of penalties.

Stipendiary Steward Mr Goodwin, using the films, identified the horses in their respective barrier stalls and showed Mr Hannam’s mount drawn out in a position of three from the outside. Mr Goodwin said that Mr Hannam sought a run closer to the running rail; he said he angled his mount inwards which to a degree dictated Tim Johnson’s mount (GERONIMO) inwards. Then Mr Hannam shifted in front of Mr Johnson’s mount and was directly in front of him. He then said that you can see GERONIMO clips a heel. He added that the side-on film showed that Mr Hannam was not clear. (GERONIMO blundered with Mr Johnson being dislodged).

Mr Hannam, for his part, said that he has been riding for 35 years and from his knowledge and recollection he has never put anyone “down” before, as such it was the first time he found himself in such a position. He said that he had ridden the filly (ART DECO) in all her trials and that she has a good turn of foot. He said that when he came across he did not realise that Tim (Johnson) was there. He thought that his horse had more speed to go forward, but that the ground (heavy) had sucked the speed out of his horse and that this dictated how fast his horse was going. He said that he was not defending himself as he had actually done it and pleaded guilty. He said the fact remains that the track played a small part that might have made a big issue. He added that after the accident had happened, that he had no idea of what had occurred. He said that he was very pleased that Tim Johnson did not get hurt and only received a cut to his hand.

Mr Hannam asked for, and was given approval by the committee, to call Mrs Allpress.

Mrs Allpress, in response to questioning from Mr Hannam, said that due to the track conditions (heavy) you think that you are going quicker than you are and that you are not getting through the ground as quickly as you think you are. She added that the track conditions were very bad and she was surprised that they were still racing. Mrs Allpress added that this was the worst track that she had ever ridden on in regards to being heavy. She said that it is very hard to get a position and maintain that position. She said that she was only riding because the others were, but that if they decided to go home, she would be happy to do so.

In response to a question from the committee, Mrs Allpress said that due to the track conditions it was proving difficult to keep your mounts on a true line and that they shifted about. She said that she was aware Robbie (Hannam) had pleaded guilty to his charges and that it is a rider’s obligation to keep the horses straight, but it is very difficult when they are not getting their footing. Mrs Allpress concluded by saying that the track was as bad as Trentham gets in the middle of July.

Submissions for Penalty:

Mr Whiterod said that Mr Hannam had an excellent record for the number of rides that he has had. His last penalty being on 24 October 2015 when he was suspended for 3 days and fined $500 for careless riding. He added that the JCA has a starting point for careless riding and concluded by saying that Mrs Allpress had stated that the horses are moving in the ground and that that could have been a contributing factor. However he said, that on this occasion Mr Hannam’s mount has moved inwards a considerable amount and that he did not believe that the movement was caused by the state of the track. He concluded by saying that Mr Hannam’s mount shifted in a long way and caused a rider to be dislodged.

Mr Hannam said that as soon as you go to push forward the horses were not getting their feet out (out of the ground) quickly enough, hence that that is why they were probably going so slow in the straight. He said that he had had no intention of doing what he did, but that he did it. He said that he would like any suspension to commence after racing on 17 July. He added that he rode everywhere in New Zealand with the exception of Whangarei and Ruakaka.

The Stipendiary Stewards said that they did not have any objection to all racing days in New Zealand being included in any term of suspension.

Reasons for Penalty:

The committee took into account that Mr Hannam had admitted the breach and had an excellent record. The committee was also mindful of the JCA starting point of 5 days suspension for careless riding. Depending on all the relevant factors, terms of suspension can obviously be reduced or increased.

The first aggravating factor was that Mr Hannam allowed his mount ART DECO to shift inwards towards the running rail abruptly, when not the required distance clear of GERONIMO. This resulted in GERONIMO being forced inwards over a considerable distance from its rightful line of running. Mr Hannam continued on an inward move and crossed directly in front of GERONIMO when not sufficiently clear.

The second aggravating factor was that as a consequence of Mr Hannam’s careless riding, GERONIMO blundered badly and dislodged its rider.

The third aggravating factor was that at no time from when Mr Hannam and his mount commenced an inward movement, up until such time as Mr Johnson was dislodged, did Mr Hannam attempt to straighten his mount’s line of running or relieve any pressure that had been placed on GERONIMO.

The Judicial Committee placed the carelessness exhibited by Mr Hannam as being in the top-range.

After careful consideration of all relevant matters pertaining to penalty, the committee believed that a term of suspension was the appropriate penalty, that it needed to be of such adequacy, that it not only suitably penalised the respondent, but would also deter other jockeys from riding in such a manner. The safety of rider and horse is paramount. The committee determined that a significant increase from the JCA starting point was warranted.
