Facts:
Following the running of Race 6, the DON’T MISS THE CAR DISPLAY ON CUP DAY 16 FEB 1200 metres, an information was filed by Stipendiary Steward, Mr Davidson alleging that B Murray (TIMES TIME) allowed his mount to shift inwards passing the 900 metres when not clear of PESHAWAR (D Prastiyou) which was crowded and checked.
Mr Murray admitted the breach and appeared at the hearing assisted by Mr Walsh.
Mr McLaughlin demonstrated on the films that Mr Murray was racing 3 wide near the 900 metres when he shifted into a 2 wide position. He said the respondent “came back into the face” of Mr Prastiyou. He was not one length and another clear.
Mr Davidson stated that Mr Murray was attempting to “reverse park” behind Mr Moseley. He said Mr Murray was a little unlucky in that there was room originally but the gap closed. Mr Prastiyou had had to take a strong hold of his horse.
Mr Murray said he believed there was room and as he had started to come in the horse had put in a jump stride and had come back on Mr Prastiyou. He believed his horse was trying to over-race.
Mr Walsh said that he agreed with Mr Murray that the pace had eased at the time the horses racing behind Mr Murray had improved. Mr Murray’s horse was not street wise. Had it been, Mr Murray might have got away with the move.

Mr Davidson identified three careless riding breaches by Mr Murray in the previous 12 months:
4 August 2018 – 8 days
8 August 2018 – 10 days
22 November 2018 — 7 days
Mr Davidson believed this breach was mid-range. He said Mr Murray was a busy apprentice and was highly sought after for South Island meetings.
Mr Walsh asked that we consider a 9-day deferment to allow Mr Murray to ride on 16 February at Invercargill. He believed a deferment of this length had recently been granted to Mr T Harris. We indicated we would investigate the matter and found that a stay had been granted to Mr Harris by an Appeals Tribunal. It was thus far removed from the raceday deferment that Mr Walsh was seeking. On hearing from the Committee, he acknowledged this was so.
Mr Murray said he no longer wished to seek a deferment. However any penalty will start after the Riccarton meeting this Saturday.
Reasons for Penalty:
Mr Murray has attempted to slot from a 3 wide to a 2 wide position and into a gap that briefly appeared in front of Mr Prastiyou. In so doing, he was not his length and another clear. It was a risky move with an experienced horse, which TIMES TIME was not. The result was that he caused a significant check to Mr Prastiyou. The breach is mid-range.
The JCA Penalty Guide provides for a starting point of a suspension of 8 national riding days for a careless riding breach found to be mid-range. We adopt this starting point.
In mitigation, Mr Murray is credited with a one day discount for his admission of the breach. We regard his record as neutral. We were told he had a clear record under the rule for the past 2 months and 3 breaches of the rule since he returned to riding some 13 months ago. This is not a bad record for a busy South Island apprentice. This leaves us with a suspension of 7 national riding days.
