Under Rule 871 (1) (d) Stipendiary Steward Mr S Ching alleged that Mr J Misbah allowed his mount HILL TO HILL to shift inwards causing KOKOMO, ridden by R Fraser, to check near the 1400 metres.

--Mr Misbah did not admit the breach and attended the hearing, assisted by Mr B Anderton, trainer.
--In evidence, Miss Fraser, rider of KOKOMO, no 2, said she jumped slowly and had Mr Misbah’s horse outside her ¾ length clear. She improved carefully and it became apparent that Mr Misbah wanted to come in to the rail. Miss Fraser called to him and was subjected to a long period of pressure – about 15 strides – she kept calling him but he was only ½ length in front and came over. Her horse KOKOMO struck the running rail.
--Stipendiary Steward Mr M Davidson showed two film views and both confirmed Miss Fraser’s evidence.
--Mr Anderton claimed Mr Misbah’s horse’s head was around showing he was trying to keep off Miss Fraser’s horse.
--Mr Ching said Mr Misbah waited and waited for Miss Fraser to improve and he still knew she was there. Mr Misbah thought he was clear but he wasn’t – forcing Miss Fraser’s horse into the rail.
--DECISION
--The Committee accepts the evidence of Miss Fraser that she made every attempt over a considerable period to warn Mr Misbah and we find the charge proven as we feel the damage had been done by the time Mr Misbah tried to correct the inward movement of his horse.
--PENALTY
--Submissions as to penalty were heard. Mr Ching said Mr Misbah had a very good record with one suspension for this rule on 2 February 2008 at the Otago Racing Club. He felt this was a mid-range offence and asked for a suspension of 4 to 6 days.
--Mr Anderton had no submission as to penalty.
--Taking 4 days for a mid-range offence as a starting point, we give credit of 1 day to Mr Misbah for his good riding record and suspend him for 3 days from today up to and including Sunday 19 October 2008.
