Mr Murray admitted the breach and it is found proved.

Penalty:

Mr Murray is suspended for 7 national riding days, from the conclusion of racing on 25 November 2018 up to and including 6 December 2018.

Facts:

Following the running of Race 7, the ASCOT PARK HOTEL HANDICAP RATING 72 1400 metres, an information was filed by Stipendiary Steward, Mr McLaughlin, alleging that B Murray (THE BUMPER) allowed his mount to shift inwards shortly after the start forcing FLICKA OF GOLD and TEDDYTWINKLETOES inwards resulting in TEDDYTWINKLETOES having to check and AMOUR LA VIE being hampered.

Mr Murray admitted the breach and appeared at the hearing assisted by Mr Walsh.

Mr McIntyre referred to the available race films, which showed Mr Murray shifting inwards after jumping from the second to outside gate. He said Mr Murray had directed his horse to the inside and the horses to his inner were all crowded and Mr Moseley (TEDDYTWINKLETOES) had to check his mount. He demonstrated that FLICKA OF GOLD (Mr Bholah) was taken inwards by Mr Murray.

Mr Murray said he had jumped out and thought he was clear when he came across. No one was yelling. He said he never knew until he was spoken to by the Stewards that he had crowded the horses to his inside.

Mr Walsh said that Mr Murray had simply “over-cooked” it. The pattern of the day’s racing was to be up on the speed and Mr Murray was attempting to find the rail.

The Committee questioned whether Mr Murray had looked. Mr McLaughlin demonstrated on the films that Mr Murray had had a little look shortly after jumping. He said the horse to the inside of Mr Murray had been a little slow to jump and this may have been the reason why Mr Murray had thought he had had enough room.

Mr Murray said FLICKA OF GOLD had been hunted up and that had been a reason why he had not been clear.

Submissions for Penalty:

Mr McLaughlin identified two careless riding breaches by Mr Murray in the previous 12 months:

4 August 2018 – 8 national riding days.

8 August 2018 – 10 national riding days.

Mr McLaughlin believed this breach was mid-range. He said Mr Murray was a busy apprentice and was highly sought after for South Island meetings.

Mr Murray did not wish to seek a deferment.

Reasons for Penalty:

The Committee finds that shortly after the start Mr Murray has commenced an inwards run when not clear of the horses to his inside. The camera angles clearly demonstrate that he was not his length and another clear. A number of horses were squeezed for room and Mr Moseley eventually had to take hold of his mount. We accept there had not been yelling and Mr Murray was unaware of the crowding he had caused until he viewed the films with the Stipendiary Stewards and Mr Walsh. To his credit he then immediately admitted the breach.

The JCA Penalty Guide provides for a starting point of a suspension of 8 national riding days for a careless riding breach held to be mid-range. We adopt this starting point.

Mr Murray has a clear record under the rule for the last 3 months and 2 breaches of the rule since he returned to riding 11 months ago. Mr McLaughlin has stated this is not a bad record for a busy South Island apprentice. We agree.

In mitigation, Mr Murray is credited with a one day discount for his admission of the breach. We regard his record as neutral. This leaves us with a suspension of 7 national riding days.
