Decision:

Accordingly after taking all of the submissions and evidence into account I find the charge proved.

Penalty:

Accordingly after taking the standard five day suspension as a starting point, I find a two day suspension is appropriate on this occasion.

Miss Morris is suspended from the conclusion of racing on Thursday 21st November 2014 to the conclusion of racing on Sunday 30th November 2014.

The meetings involved in the suspension:

28th November, Winton 2014.
30th November, Cromwell 2014.

Facts:

Following the running of Race 6 the ILT Foundation Handicap an Information (A3874) was lodged by Stipendiary Steward Mr M Davidson alleging that Class A rider Miss J Morris permitted her mount SAPERAVIOUS to shift inwards when not sufficiently clear, forcing RIKHO (Miss A Edmeads) inwards crowding HEAPZACASH (D Skerrett) which was checked by the 1000 metres.

Miss Morris acknowledged that she understood the nature of the charge and the rule, and confirmed that she did not admit the breach.

Rule 638(1)(D) provides,

A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Submissions for Decision:

Stipendiary Steward Mr J Oatham identified the horses on the head on and side on films of the alleged incident. Mr Oatham pointed out SAPERAVIOUS ridden by Miss Morris shifting inwards when racing on the outside of RIKHO ridden by Miss Edmeads.

Mr Oatham stated that SAPERAVIOUS was only a long neck to half a head clear of RIKHO when the inwards movement commenced, which forced RIKHO inwards eventually leaving insufficient room for HEAPZACASH ridden by Mr Skerrett who was checked.

Mr Oatham used the films to highlight the alleged incident to demonstrate further the action Mr Skerrett had to take.

Mr Oatham also asked Mr Skerrett where the movement had come from which had caused his horse to be checked. Mr Skerrett stated that he believed it had come from RIKHO ridden by Miss Edmeads, Mr Skerrett said he was unaware of the horse racing in the three wide position SAPERAVIOUS, and if it had shifted inwards.

Miss Edmeads stated that her horse RIKHO had held its line as it was entitled to, and when questioned she did not believe her horse had contributed to the incident.

Miss Morris stated that her horse SAPERAVIOUS and RIKHO had challenged for the lead and that she looked inwards to ‘determine what RIKHO and Miss Edmeads were going to do, either press forward, or take a hold on her horse.

Miss Morris did not contest the fact that she had moved inwards except that she believed Miss Edmeads should have been more pro-active and made a decision on what she was going to do.

Miss Morris believed that Miss Edmeads' lack of action has contributed to the incident.

Mr Oatham was of the opinion that Miss Morris had simply reacted too slowly it was “too little too late” in his view.

Reasons for Decision:

After carefully considering the evidence and reviewing the video films, I was clearly satisfied that Miss Morris has shifted inwards when not sufficiently clear of RIKHO as she is required to be under the rule.

This was supported by the evidence given by the Stipendiary Stewards and confirmed on the video films.

Submissions for Penalty:

Mr Davidson stated that Miss Morris was a senior rider and had an excellent record over the past twelve months. Miss Morris had had one previous breach under this rule in the past twelve months where she received a three day suspension at the Kumara Meeting.

Mr Davidson also submitted that he believed the breach was at the very low end of carelessness.

Miss Morris since the beginning of the season has had 64 race day rides.

Miss Morris said she had commitments at the Winton Meeting on 28th of November 2014 and at the Cromwell meeting on the 30th of November 2014. There were high stakes on offer that day as it was a Feature Meeting.

Reasons for Penalty:

After considering the submissions as presented, the mitigating factors in this Charge are that Miss Morris has a very good riding record over the past twelve months and that the level of carelessness in this incident was at the very low end.

The horses that were affected did not have their chances hindered or hampered as a result of the inwards movement. Clearly Miss Morris has made a simple error of judgement where she has reacted too late to the situation.

Credit was also given to Miss Morris for her very open and forthright manner in giving her evidence when defending the charge.
