As Mr Khetto has admitted the breach, it is found to be proved.

Penalty:

Mr Khetto does not seek any deferment of his suspension. He is suspended from riding from the end of racing today up to and including 6 March. He is also fined the sum of $250.

Facts:

Mr Davidson alleged that Mr Khetto rode carelessly in Race 8 in that he permitted his mount HE’S GOT POWER to shift inwards when not sufficiently clear of VEE TWELVE which was checked near the 800 metres.

Mr McIntyre demonstrated on the videos that the Respondent near the 800 metres shifted inwards towards the rail. In so doing, he crowded Mr Mudhoo who had to take a strong hold of his mount. Mr Mudhoo made contact with the fence and lost ground.

Mr Khetto said it had been a hard ride and he had thought he was clear when he crossed.

Mr Walsh said that prior to the Respondent shifting in, HE’S GOT POWER had been pulling hard and over-racing. All Mr Khetto had had to do, was to stay out a little longer.

Mr Davidson agreed that HE’S GOT POWER had been over-racing. He added that Mr Mudhoo had told the Stewards that he was happy for Mr Khetto to go forward and Mr Khetto had simply crossed too soon.

Submissions for Penalty:

Mr Davidson produced the Respondent’s record which was clear under this Rule. It was Mr Khetto’s 12th ride. The Stewards viewed the breach as above mid-range. He believed a six to seven-day starting point was appropriate. He also submitted the fine be at the lower end of the range.

Reasons for Penalty:

Mr Khetto has admitted a breach which we assess as clearly being above mid-range. He has put Mr Mudhoo in some difficulty near the 800 metres by shifting in when not his length and another clear. Mr Mudhoo has had to check his mount as a consequence. It was a severe check and he briefly came into contact with the rail. We take a seven-day starting point.

Mr Khetto is an inexperienced South Island apprentice with an otherwise clear record. He has admitted the breach. A one-day reduction is appropriate from the seven-day starting point. In considering the appropriate fine, we take into account that Mr Khetto has had difficulty in obtaining rides and indeed he has been between employers for a short time, and the fact that this is a first breach for a young South Island apprentice. Both he and Mr Walsh have said he will learn from this experience. We do not doubt this.
