Mr Bholah admitted the charge and it is found proved.

Facts:

Mr Bholah was charged with breaching r 638(3)(b)(ii), in that he used his whip excessively when riding out his mount NEVER QUITZ when not in a position to finish in a stake bearing placing. Mr Bholah admitted the charge and was assisted at the hearing by Mr Walsh.

Miss Haley, with the use of the videos, showed the position of NEVER QUITZ at the rear of the field at the 400m mark. Mr McIntyre stated that NEVER QUITZ at that point was losing ground. He said Mr Bholah was seen to use his whip nine times inside the final 400m when out of contention. NEVER QUITZ finished in 11th placing.

Mr Bholah stated he had been a bit aggressive but added he expected his mount to finish out the race better. Mr Walsh said NEVER QUITZ had raced keenly for the first 800 metres and was a difficult ride. Mr Bholah was a relatively inexperienced rider and had been off the track for some time following a race-day injury he received over 12 months ago.

Mr McIntyre said Mr Bholah had a clear record and due to injury had only ridden 24 rides this season. He said the start point for a first offence under the JCA Penalty Guide was a fine of $300.

Mr Walsh said Mr Bholah had only had 74 life time rides. He had no previous charges in the last 12 months. He felt Mr Bholah had not fully understood the importance of not using his whip on a runner out of contention.

Mr Bholah admitted the breach and has a clear record. A fine at the low end of the scale is appropriate.
