Decision:

I thus find the charge of careless riding proved.

Penalty:

Mr Callaway is suspended for 3 days: Timaru 23 February, Awapuni 27 February, and Omakau 28 February. The suspension commences after racing on 17 February and ends at the conclusion of racing on 28 February.

Facts:

Mr McLaughlin, Stipendiary Steward, demonstrated on 3 video angles (side-on, back straight and trackside) that Mr Callaway was racing 3 wide some 300 metres after the start and, he shifted inwards crowding Mr Bothamley. Mr McLaughlin showed Ms Morris was ahead of both Mr Callaway and Mr Bothamley, and was moving towards the rail. He believed Mr Callaway was following her to the rail. Mr Bothamley was 2 wide and he was forced to take hold of his horse when he was checked by Mr Callaway.

Mr Callaway questioned Mr McLaughlin as to whether he believed Mr Bothamley’s mount was over-racing at the time. Mr McLaughlin responded that he did not.

Submissions for Decision:

Mr Wallis called Mr Bothamley to give evidence. Mr Bothamley stated he was racing 2 wide at the time of the incident. He said he was “going at a steady clip”. His horse was pulling a little but was not over-racing. He said he clipped the heels of Mr Callaway when the respondent moved from 3 to 2 wide when he was not clear. He had had to check his horse as a result. He said he had a nice sit after jumping and it was his intention to stay 2 wide. In response to questioning by Mr Callaway, Mr Bothamley said his mount had over-raced earlier in the run but was not over-racing at the time of the check.

Mr Callaway stated that he was following Ms Morris. He said his horse was wearing blinkers, had a pricker on its inside and was laying in at the time. He said his mount did not like the ground and felt green. He believed when he crossed Mr Bothamley, THE BELIEVER had grabbed the bit and thrown its head. Other jockeys had told him that THE BELIEVER could travel nicely one minute and charge forward the next. He was unaware that Mr Bothamley had clipped his heels and he believed Mr Bothamley had “run up his bum”.

Mr Callaway paused the videos at a point that he believed showed that he was clear of Mr Bothamley when he crossed. Mr Wallis disputed this, stating that at this point in time Mr Callaway was still 3 wide and was yet to cross Mr Bothamley. Mr Callaway responded that he believed he was two and a half wide at the time and that he was a length and a half clear of Mr Bothamley.

In summing up Mr Wallis pointed out that THE BELIEVER was having its first start so any comments from jockeys with respect to that horse’s racing manners had to relate to a trials situation. He emphasised the videos clearly demonstrated Mr Callaway was not clear of Mr Bothamley when he crossed.

Mr Callaway reiterated he was clear and Mr Bothamley was checked because his horse had taken off on him.

Reasons for Decision:

I am satisfied from viewing the various video angles, and the oral evidence of Mr Bothamley that Mr Callaway was not his length and another clear when he endeavoured to follow Ms Morris to the running rail near the 800 metre mark. Indeed, Mr Callaway has said himself that he was only a length and a half clear. The consequence of Mr Callaway’s actions is that Mr Bothamley has had to check his mount, losing his position, and Mr Bothamley is adamant that he also clipped heels with Mr Callaway.

Submissions for Penalty:

Mr Wallis produced the respondent’s record, which was clear under this rule this season. He stated Mr Callaway was a busy rider who rode in the Central Districts from time to time. He submitted a 3 day suspension was appropriate.

Mr Callaway said his record was good and he confirmed that he rode in the Central Districts. When questioned by the Committee, he indicated he was not intending to ride at Otaki on 22 February.

Reasons for Penalty:

I am satisfied that the breach is towards the lower end of the range. However, Mr Bothamley was entitled to his racing room and he did not receive this because of the actions of Mr Callaway.

Mr Callaway is a busy rider and his record is a very good one. From a five day starting point, I give a one-day reduction for record and another for the fact that he rides primarily in the South Island.
