Decision:

Miss Morgan admitted the breach. We thus find the charge proved. It was clear from the video evidence that Miss Morgan (VENETIAN RADAR) was not sufficiently clear, when crossing over in front of CAPTAIN KIRK (Mr Prastiyou) who had to take a hold of his horse and was checked.

Penalty:

Miss Morgan was suspended from the conclusion of racing on Monday 17th February 2014, to the conclusion of racing on Sunday 28th February. This is 3 days.

Facts:

At the conclusion of race 4 The GJ Gardiner Homes Southland Stakes an information was lodged by Stipendiary Steward Mr N McIntyre alleging that Apprentice Jockey Miss A Morgan rider of VENETIAN RAIDER permitted her mount to shift inwards near the 900 metres causing CAPTIN KIRK (D Prastiyou) to check.

The rule reads:  638(1)(d) No horseman shall ride carelessly

Miss Morgan admitted the breach. 

Stipendiary Steward Mr McIntyre showed the Committee several video clips of the alleged breach.

Mr McIntyre stated that VENETIAN RAIDER had drawn six and jumped from the starting gates awkwardly. CAPTAIN KIRK (D Prastiyou) had drawn the outside starting gate, and appeared to be crossing over to go into the lead, however VENETIAN RAIDER pushed up and crossed over to the lead, forcing CAPTAIN KIRK to drop back into the trailing position and as a result was checked.

Mr McIntyre stated that Miss Morgan was not sufficiently clear of CAPTAIN KIRK when crossing , as the horses raced into the apex of the bend.

Mr Pitman stated that that VENETIAN RAIDER was a natural front runner and that on this occasion Miss Morgan may have been a victim of circumstance, as CAPTAIN KIRK was also a known front runner.

Mr McIntyre in response to questioning from the Committee demonstrated that Miss Morgan looked across twice to see if there was sufficient room to cross.

Submissions for Penalty:

Mr McIntyre stated that Miss Morgan had one previous breach of this rule in the past twelve months, at the Banks Penn Meeting on the 3/11/2013 where she was suspended for four riding days (including a meeting in the central districts).

Mr McIntyre stated he believed the breach to be low to mid-range of carelessness. Mr McIntyre confirmed that Miss Morgan had 140 rides this season, and that she had a good record.

Mr Pitman stated that Miss Morgan was possibly riding at Otaki 22/2/14 and definitely riding at Timaru 23/2/14 and also Omakau on 28/2/14.

Mr Pitman asked the Committee when fixing penalty to consider Miss Morgan’s good riding record and her admission of the breach.

Reasons for Penalty:

The Committee in fixing penalty took into account that the breach was low to mid-range, also Miss Morgan’s good riding record and admission of the breach.
