At the conclusion of race 5 The Sheet Metalcraft LTD Handicap an information was lodged by Stipendiary Steward Mr M Zarb alleging that Apprentice Jockey Rebecca Black used her whip unnecessarily when her horse ASHLEY was not in contention.

Miss Black admitted the breach.
 
The rule reads : 638(3)(b)
A rider shall not strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper;
 

Facts:

Stipendiary Steward Mr M Zarb showed the Committee several video clips of the alleged incident , highlighting the use of the whip by Apprentice Jockey Rebecca Black. Mr Zarb stated that ASHLEY was hit eight times from the top of the straight close to the winning post, when clearly the horse had drifted out and had no chance of claiming a stakes bearing place.  Mr Zarb stated that it was totally unnecessary.
Miss R Black after having admitted the breach said she had misunderstood the rule and made a mistake. She also stated that the horse was better than it had performed on the day – and as a result she had tried to wake it up.
 
Mr Zarb stated that Miss Black had no previous breaches under this rule over the past twelve months, and he believed a monetary penalty would be appropriate.

It was clear from the video evidence that Miss Black had used her whip at least eight times from the top of the straight to the winning post when the horse was drifting out and not responding to Miss Blacks initial urging warning not to report her actions in the future as it was a very bad look for the industry and animal welfare and her actions were simply not acceptable.
