Facts:
Following the running of race 5 the Homestead Cobb & Co/Homestead Villa Motel Maiden stewards lodged a request for a ruling “To determine if the start was fair with Nomen Ludi (R Cuneen) started in barrier (4) when should have been barrier (5) and Shotglass (D Bothamley) started in barrier (5) when should have been in barrier (4).”
Rule 631 (8) reads:
If any horse starts from an incorrect stall position, the Judicial Committee shall have the discretion to confirm the Official Result of Placings, declare the race to be void or declare any horse in the Race to be a non-starter.
Submissions for Decision:
Mr Davidson said that prior to the meeting Sapphon (13) was a late scratching. This was noted by the Stewards and the Starter. However when reviewing the videos it was found that Shotglass and Nomen Ludi had both started from incorrect barriers. The race was over 2100m and all runners had time to sort themselves out after the jump. Neither horse was disadvantaged at the start with both runners finishing out of stake bearing positions. The official placings were Nomen Ludi 6th and Shotglass 9th. He said neither Mr Cuneen, or Mr Bothamley said there chances were affected.
Mr Cuneen stated his horse was giving him trouble when loading and he wasn’t sure if he was to start from barrier five or six. Mr Bothamley believed he was in the right stall. They both confirmed there horse’s chances were not affected.
Mr Price stated he had noted the late scratching on his sheet. However, prior to the start and during loading there were heavy showers passing through and his notes became unreadable. He had several runners that were fractious loading and he had not realised both horses were loaded incorrectly.
Reasons for Decision:
The committee has to determine if either one or both horses were disadvantaged by being in the incorrect barriers at the start. Both horses drew next to each other and started next to each other. Neither horse missed the jump with Nomen Ludi finishing 6th and Shotglass 9th. Both Mr Cuneen and Mr Bothamley stated their chances were not affected.
