As Mr Mudhoo had admitted the breach the charge was found proved.

Penalty:

Accordingly, Mr Mudhoo’s Class A Jockey’s License is suspended from the conclusion of racing 12 December 2020 (four days) until the conclusion of racing on Saturday 19th December 2020. In addition, a $250 fine was imposed.

Facts:

Following the running of Race 7 the Edge handicap an Information 11753 was filed by Stipendiary Steward Mr M Davidson against Class A Rider, Mr K Mudhoo, alleging careless riding in that he permitted his mount Gerry Joyce to shift inwards when not clear of Top Of The Straight (R Mudhoo) near the 500 metres which was checked.

Rule 638 (1) (d) reads as follows:

1. A rider shall not ride a horse in which the judicial committee considers to be
(d) Careless

Mr K Mudhoo had indicated on the Information that this breach of the Rules was admitted which he confirmed at the hearing, Mr Mudhoo also agreed that he understood the charge and the Rule it was brought under.

Mr Mudhoo also acknowledged he understood the revised Penalty Guidelines for careless riding that came into force on 9 December 2020.

Mr McIntyre gave evidence and used the video footage to highlight Gerry Joyce (K Mudhoo) near the 500-metre mark shifting ground inwards causing the trailing horse Top Of The Straight (R Mudhoo) to be restrained and checked losing momentum.

Mr K Mudhoo stated that the video evidence was clear and accurate.

Submissions for Penalty:

Mr Davidson stated that Mr Mudhoo had a good record, with one previous breach of this Rule over the prior 6 months being 24 October 2020 at Canterbury where he received a 5-day suspension.

Mr Davidson stated that this breach was at the low end of the scale. Mr Davidson stated that Mr Mudhoo was a very successful and busy rider with up to six rides per race day.

Mr Mudhoo made no submissions on penalty. Deferment was discussed however Mr Mudhoo did not request this option.

Reasons for Penalty:

The JCA revised Penalty Guide as of 9/12/20 provides for careless riding at a low range, a starting point of a $250 fine and a 4-day suspension.

In considering fixing penalty the breach was at the low end, and although Mr Mudhoo has received a previous suspension under this Rule on 24 October 2020, his early guilty plea and busy riding schedule, mitigated any increase in penalty above the guidelines in this particular instance.
