Facts:
Following the running of Race 2, McKnight and Brown Maiden, an Information A11772 was filed by Stipendiary Steward, Mr M Davidson against Apprentice Jockey, Mr C Campbell alleging careless riding in that he permitted his mount SALISBURY to shift inwards when not sufficiently clear dictating SLINKY LINKY (T Jonker) inwards crowding SOVIET WONDER (D Bothamley), LILY OF THE VALLEY (M Gestain), UP MY SLEEVE (C Johnson) and ROSY CLARK (C Barnes), near the 1000 metres.
Rule 638(1)(d) reads as follows:
1.-A rider shall not ride a horse in which the judicial committee considers to be
d. -Careless
Mr Campbell has indicated on the Information that this breach of the Rules was admitted, which he confirmed at the hearing. Mr Campbell also agreed that he understood the charge and the Rule It was brought under.
Mr Oatham (Chief Stipendiary Steward) gave evidence and used the video coverage to highlight the incident. Mr Oatham made reference to the earlier incident in the Race where there had been some earlier tightening, stating that the horses were racing in tight quarters from this point.
Mr Oatham stated that SALISBURY was laying in when racing on the outside of SLINK LINKY (T Jonker) and was only half a length clear when shifting inwards dictating SLINKY LINKY’s line, and as a result there was a concertina effect to SOVIET WONDER, LILY OF THE VALLEY, UP MY SLEEVE and ROSY CLARK.
Mr Oatham stated that the movement was minimal, but the consequences were high.
Mr Campbell stated that his horse laying in had not helped and that he had simply made an error or judgement and had crossed too soon.
Mr Walsh (Apprentice Mentor) supporting Mr Campbell stated that the earlier tightening in the race had not helped the incident and that Mr Campbell had made an error in not being sufficiently clear. If he had waited for a couple more strides, he would’ve been okay.
Submissions for Penalty:
Mr Davidson said that Mr Campbell was a very busy, successful Apprentice Jockey. Mr Campbell has had 250 rides this season and had received a five-day suspension at the Winton Jockey Club on the 26/10/2020 for a breach under the same Rule which was deemed low to mid-range.
Mr Davidson believed the breach today was mid-range with a suspension of 6 – 7 days and a fine being appropriate.
Mr Campbell requested a deferment of penalty and had no further submissions.

The Committee placed the carelessness in the mid-range category with the JCA Penalty Guide starting point being a five-day suspension plus a fine of $500.
The aggravating factor in fixing penalty being Mr Campbell’s earlier five-day suspension and in this instance the carelessness was mid-range effecting five horses and riders, an uplift of two days was the starting point.
Mr Campbell was given credit for his early admittance of the breach with a one-day discount being applied, with consideration given that he was a very busy and in demand Apprentice Jockey.
Mr Campbell’s deferment of penalty was granted.
