Mr Davidson alleged that Mr Blair-Edie presented LEICA BUD to race with the girth being connected to a stirrup leather.
Facts:
Mr Davidson said that the saddling error had been picked up in the birdcage. He explained that Mr Blair-Edie and an experienced stable-hand had saddled the horse, the defendant on one side and the stable-hand on the other. It was the stable-hand’s side that had been saddled incorrectly. Mr Davidson further stated that the defendant had not checked LEICA BUD before presenting it in the birdcage as he was in a hurry.
Submissions for Penalty:
Mr Davidson produced the defendant’s record, which was excellent under this rule, and submitted a fine in the range of $100 to $200 was appropriate.
Reasons for Penalty:
We believe there is a safety issue involved with this particular breach and note that a similar breach occurred with respect to defendant D at Cromwell on 27 November last. The penalty on that occasion was a fine of $200, but the error was not detected until the horse reached the barrier. Taking into account the fact that the error was detected earlier in the case before us today, the defendant’s admission and his very good record, we believe a fine near the top of the range suggested by Mr Davidson is appropriate.
