Decision:

As Mr Doherty admitted the breach, we find the charge proved.

Penalty:

Mr Doherty is suspended from the end of racing today up to and including 17 December. This is in effect 3 days’ suspension. He able to ride again at Gore on Sunday 18 December.

Charge:

Mr Davidson alleged that Mr Doherty permitted his mount KRISSIES CHOICE, to shift outwards, passing the 250 metre mark, causing severe crowding to outside runners with DANZA ROSE (L Robinson), LA GEE (M Misbah) and COPPER TAP (L Callaway) being checked.

Facts:

Mr Davidson had Mr McLaughlin, Stipendiary Steward, demonstrate the incident on the videos. He said that as the horses turned for home the defendant, who was trailing the leading horse, moved out looking for a run and, in so doing, knocked Mr Yusoff’s horse, which was racing on his outer. As a consequence, the horses outside that runner were all squeezed for room.

Mr Gordon, who spoke on the defendant’s behalf, said Mr McLaughlin’s analysis of the videos was accurate but he asked us to consider that the horse was a first starter and was green. He also believed that the fact that Mr Yusoff was also an apprentice had had an impact on the incident.

Submissions for Penalty:

Mr Davidson produced the defendant’s record, which was clear this season. He described the breach as at the lower end of the scale and submitted a suspension of 4 days was appropriate. He asked us to regard the defendant as a national rider.

Mr Gordon submitted a 3 day suspension was appropriate, having regard to the greenness of the horse.

Reasons for Penalty:

Mr Doherty has come out from on the rail behind the leader as the field turned for home in race 2. There was no run for him at the time. In so doing he has come into contact with the mount of another apprentice, Mr Yusoff, who was squeezed and pushed wider on the track, There was a concertina effect with a number of the runners on the defendant’s outside being affected.

We take a starting point of 5 days for the breach, which we accept is at the lower end of the scale of careless riding. The find the defendant’s culpability is not high in that we accept KRISSIES CHOICE over-reacted when Mr Doherty came out looking for a run. But the consequence was that a number of horses became unbalanced at a crucial stage in the race.

We propose to give the defendant a day’s credit for his very good record, which is tempered a little by his only having 21 rides this season (both on the flat and over the jumps), and also for his admission of the breach.
