At the conclusion of race 3 a protest was lodged by Stipendary Steward Mr S. Ching alleging that the second placed horse by the judge, Atom (Miss L. McGregor) interfered with the 4th placed horse Finntorri (Mr D. Bothamley) inside the concluding 100m of the race.

Decision and Reason:

At the conclusion of race 3 a protest was lodged by Stipendary Steward Mr S. Ching alleging that the second placed horse by the judge, Atom (Miss L. McGregor) interfered with the 4th placed horse Finntorri (Mr D. Bothamley) inside the concluding 100m of the race.

Mr Ching used several video clips to highlight where he believed the alleged interference took place. He highlighted in his opinion the outward movement of Atom, which was racing alongside the running rail ? moving outwards and making contact with Finntorri (D. Bothamley). He then impressed upon the committee the margins between the third and fourth placed horses being a neck. He also maintained that, in his opinion Finntorri, without the alleged interference would have finished closer to a dividend bearing place.

Evidence was heard from D. Bothamley (Finntorri) who stated that he had to stop riding his horse for at least four or five strides costing his horse at least a length due to the alleged interference. When questioned he stated that he believed that at the alleged point of contact, his horse was still running on.

Miss Scholes stated that in her opinion, whilst interference did happen, she believed that the jockey of Finntorri (Mr Bothamley) added to the problem by not vigorously riding his horse out ? Mr Bothamley replied that he was unable to do so because of loss of balance.

Decision and Reason:

The protest was upheld and the second placed horse by the judge (Atom) was relegated to fourth placing. Biman was promoted from third to second and Finntorri promoted from fourth to third.

The committee considered all of the video and oral evidence and concluded that Atom had moved off the fence and came into contact with Finntorri stopping this horses momentum for at least 4-5 strides and in doing so not accounting the horse to be ridden out to gain a higher placing. The margin between 3rd and 4th (neck) was also significant in the decision to relegate.
