Facts:
Following race 8 Mr M Davidson alleged that Mr J and Mrs K Parsons, were neglectful in saddling REVELATOR in that a towel was omitted from the gear after the rider had weighed out with the towel.
Rule 614(2) states:
A person must not be neglectful or careless in saddling a horse.
Mr Parsons acknowledged that he understood the Rule and admitted the breach. He signed the information stating that he did not want to attend the hearing.
Stipendiary Steward Mr L Tidmarsh observed that when the jockey, Ms Tina Comignaghi (REVELATOR) weighed in, she was 0.3kg under the correct weight. On inspection of the gear it was noticed that a towel was omitted. Mr Tidmarsh then went to the stabling area and spoke with Mr J Parsons, who admitted he had failed to use the towel when saddling the horse prior to the race.
Submissions for Penalty:
Mr Davidson explained to the committee that under Rule 648 there is a tolerance of 0.5kg. If above this threshold then the consequences would be far higher.
The Parsons’ have a clear record under this rule.
There are very few similar cases where a towel has been omitted, the Molloy case in 2013 is one where the horse was not disqualified. In this instance Molloy was fined the sum of $200.
Mr Davidson suggested a fine in the vicinity of this would be suggested.

Mitigating factors are the respondent’s admission of the breach, their clear record and their full cooperation surrounding the charge.
