Accordingly Miss Collett is suspended from race riding from after the conclusion of racing on Saturday 19 March 2011 until after the conclusion of racing on Friday 25 March 2011. This equates to four riding days.
Charge:
That apprentice jockey Miss A Collett permitted her mount MIDIUM DIVA to shift inwards near the 150 metres when not sufficiently clear of LUCKY BREAK ( P Taylor) which was checked.
Facts:
Mr J Oatham interpreted the incident by way of available head and side on video footage. Mr Oatham told the committee that at about the 150 metre mark, FONZIE ridden by jockey Mr G Swann was racing on the outside of MIDIUM DIVA ridden by apprentice jockey Miss A Collett, and drifted in under pressure. As a result Miss Collett's mount also drifted inward. Miss Collett made some attempt to straighten her mount but at the same time continued to use her whip. Mr Oatham advised the committee that during this manoeuvre, Miss Collett crossed the path of LUCK BREAK ridden by jockey Mr P Taylor and at no time was Miss Collett's mount sufficiently clear. Mr Taylor had to stand and take hold of his mount for several strides and as a consequence was checked.
Submissions for Decision:
Mr Williamson submitted that although Miss Collett made an attempt to straigten her mount, she immediately went for her whip and continued to use it. He advised the committee that Miss Collett had an obligation to straighten her mount before continuing to use her whip.
Mr Oatham submitted that at no point was Miss Collett sufficiently clear of LUCKY BREAK and she allowed her mount to lay in until the 100 metre mark.
Mrs J Collett, on behalf of apprentice jockey A Collett submitted that MIDIUM DIVA was irratic and was running in a hood for the first time. Mr P Jenkins, on behalf of apprentice jockey A Collett submitted that the interference was marginal and that jockey P Taylor over reacted.
Submissions for Penalty:
Mr Williamson submitted that Miss Collett admitted the beach of the rule at the first possible opportunity and in his view the breach was at the lower end of the scale. He advised that Miss Collett has two previous breaches of rule 638(1)(d) in the past 12 months.
Miss Collect, submitted that she was giving her horse every chance. She did not offer any further submissions as to penalty.
Mr Jenkins submitted that Miss Collett has confirmed riding engagements for Saturday 19 March 2011 and also has an opportunity to ride at Invercargill on Sunday 20 March 2011, but as yet her mounts are not confirmed. He asked the committee take into account the opportunity for Miss Collect to ride in Invercargill when afixing penalty.
Reasons for Penalty:
On the basis of the evidence provided to the Committee, it is clear that Miss Collett allowed her mount to lay in for approximately 50 metres resulting in Mr Taylor having to take hold of his mount for at least three strides. Miss Collett did make an effort to straighten her mount, but continued to use her whip whilst taking the running line of Mr Taylors mount. This is an aggravating factor.
The committee acknowledges that the inward movement of FONZIE may have been a contributory factor, but this should not detract from Miss Collett's obligation to straighten her mount under these circumstances. This is a mitigating factor.
In assessing penalty the Committee commenced deliberations on the basis that a suspension of five riding days is the starting point for a breach of Rule 638(1)(d). The Committee has assessed this incident at the lower end of carelessness and has given due weight to Miss Collett's admission and her relatively good riding record. The Committee also has taken into account Miss Colletts opportunity to ride in Invercargill on Sunday 20 March 2011, albeit that pending riding engagements have not been confirmed.
In consideratiion of Miss Colletts admission of the breach, her relatively good riding record and our assessment that this breach is at the lower end of the scale the Committee imposes a four day suspension.
