Penalty:
The Committee granted a deferment to Mr Kareem’s suspension pursuant to Rule 1106(2).
Accordingly, Mr Kareem’s license to ride in races was suspended for a period to commence after racing on 14 March 2020 and conclude after racing on 26 March 2020.
The 15 March race meeting at Woodville was not included in the penalty because the declaration of riders had already closed.
Facts:
Following the running of race 5, HOLSTER ENGINEERING LALLY AND SYMES SOUTH WAIKATO CUP (2000 metres) an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Kareem permitted MASTER PAINTON to shift in near the 1250 metres when insufficiently clear of JOE CARGO which was checked.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Kareem said that he understood the Rule and confirmed he admitted the breach.
Mr Harris assisted Mr Kareem at the hearing.
Mr Jones demonstrated the incident using the available video footage. He identified that Mr Kareem was racing in a 3 wide position when he allowed his mount to shift in to a 1 off position. In doing so he was not sufficiently clear of JOE CARGO which was checked.
Mr Harris said that Mr Kareem made a quick inward manoeuvre when not clear of JOE CARGO.
Mr Kareem said that when he shifted in, he thought he was clear of JOE CARGO.
Submissions for Penalty:
Mr Williamson said that Mr Kareem had one previous breach under this Rule in the last 12 months from 109 rides. He said the level of carelessness was mid-range and asked the Committee to take into account that Mr Kareem is a relatively inexperienced Apprentice rider.
Mr Kareem said that any proposed suspension could start after racing on 14 March 2020.
Mr Harris submitted that Mr Kareem was an inexperienced rider.

The Committee considered all the evidence and submissions presented.
When reviewing the video films, the Committee deemed the level of carelessness displayed by Mr Kareem was mid-range. It was clear that Mr Kareem allowed his mount to shift in sharply when only ¾ of a length clear of JOE CARGO. As a result, that runner was checked and lost ground.
The JCA Penalty Guide starting point for mid-range carelessness is 8 national riding days which was adopted.
The mitigating factors were Mr Kareem’s admission of the breach and his good record. For these combined factors he was afforded a 1-day reduction in penalty.
The Committee accepts that Mr Kareem is still learning his trade however given that he has had 109 rides to date no reduction in penalty was applied.
After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
