Decision: Following race 6 an information was lodged pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham that Mr Ismail committed a breach of that rule when he allowed CATWOMAN to shift in when not clear of CATSNATCHER
Following race 6 an information was lodged pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham that Mr Ismail committed a breach of that rule when he allowed CATWOMAN to shift in when not clear of CATSNATCHER (J McDonald) who had to check sharply losing ground 200 metres from the finish.

Mr Ismail, who was represented by Mr J Sargent, admitted the charge.

Mr Coles demonstrated the video. He showed where, soon after entering the straight, Mr Ismail used the whip on CATWOMAN who immediately ran in and put pressure on CATSNATCHER. Mr Ismail straightened his mount before using the whip again. This time he continued to ride his mount as he took the line of CATSNATCHER who was severely checked.

As Mr Ismail has pleaded guilty the committee is required to adjudicate on penalty only.

Mr Oatham gave Mr Ismail’s record which showed that this was his 2nd charge from 14 rides. In asking for a suspension he said he considered the offence to be at the higher end of the scale.

Mr Sargent said that he had arranged for retired rider Mr D Weatherly to help improve Mr Ismail’s riding.

In coming to its decision the committee considered :

1. Mr Ismail’s admission of guilt.

--3. The level of interference.

The committee expresses some concern with Mr Ismail’s record and the level of interference in this case. It does, however, commend Mr Sargent for the assistance he has instigated. The committee suspends Mr Ismail from race riding beginning after the finish of racing today 11 March till the finish of racing on 28 March 2009 (6days).
