DECISION & REASON

--

An information was lodged by the Stipendiary Stewards alleging a breach of Rule 520 (4) (c) in that Mr J S Bullard failed to make the carded weight for his rides in races 4 and 7.

At the outset of the hearing Mr Bullard acknowledged that he understood the charge and confirmed his written acknowledgement of the breach.

The breach is accordingly found proven.

Mr Ching advised the Committee that prior to race 3 Mr Bullard had told the Stipendiary Stewards that he was unable to make the weight of 56 kgs for his engaged ride on MISS KEY in race 4 and in respect of WAZAWATSYN in race 8. Mr Bullard's weight for the day was 58 kgs. Mr Ching also advised the Committee that Mr Bullard had been replaced for those rides.

Mr Ching indicated that although in the past Mr Bullard had some issues with weight over the last 12 months he had not appeared before a judicial committee in respect of such a charge. Mr Ching indicated that the Stipendiary Stewards on this occasion were seeking a monetary penalty only and that credit should be given to Mr Bullard's frankness, his early guilty plea and that he was able to ride at 56 kgs the previous Sunday.

Mr Bullard said that he was only just getting back into riding after taking a three month break at which time he sought to stabilise his weight. He confirmed that he had ridden at 56 kgs the previous Sunday and had believed that he would be able to ride at that weight today. He also asked that a monetary penalty only be imposed.

The Committee after taking into account the submissions, including the mitigating matters referred to by Mr Ching, is of the view that the penalty on this occasion can be by way of fine only and accordingly a fine of $250.00 is imposed.
