Following the running of race 1 an information was lodged by the Stipendiary Stewards under rule 908 (2) alleging that Mr Walker, through his representative Mr Clutterbuck, had failed to ensure that the correct saddle cloth was placed on PARAIBA.

DECISION & REASON

Following the running of race 1 an information was lodged by the Stipendiary Stewards under rule 908 (2) alleging that Mr Walker, through his representative Mr Clutterbuck, had failed to ensure that the correct saddle cloth was placed on PARAIBA.

At the outset of the hearing Mr Clutterbuck acknowledged on behalf of Mr Walker that he understood the rule and confirmed his written acknowledgment of the breach.

The breach is accordingly found proven.

Mr Ching advised the Committee that prior to the running of race 1 Mr Humphries, Assistant Stipendiary Steward, had advised him that PARAIBA was wearing saddle cloth number 6 and not saddle cloth number 9.

He also advised that when PARAIBA entered the birdcage the Club was unable to find the saddle cloth number 9. Saddle cloth number 6 was removed and permission was given for the horse to race in saddle cloth number 10.

Mr Clutterbuck indicated that he was delivered the saddle and saddle cloth by the rider and placed it on the horse and at some stage prior to entering the birdcage he became aware that the horse was wearing the wrong saddle cloth. He further stated that on arriving in the birdcage he attempted to have the saddle cloth number 6 replaced with saddle cloth number 9 but as no saddle cloth number 9 saddle cloth was available the horse was re-saddled with saddle cloth number 10 with the consent of the Stipendiary Stewards.

The Committee after taking into account the submissions of Mr Ching and Mr Clutterbuck is of the view that a penalty must be imposed and after giving consideration to the role of Mr Clutterbuck in this matter imposes a fine of $100.00.
