Miss Morris admitted the breach and appeared at the hearing to give evidence. After viewing the films and hearing the evidence of the Stewards, the charge was found proved.

Facts:
Following the running of Race 11, the MCINTOSH CATERING STAYERS RATING 75 2100m, an information was filed pursuant to Rule 638 (3 )(b)(ii). The informant, Mr McLaughlin alleged that Miss Morris (McMay) used the whip excessively prior to the 200 metres when riding McMay.
Miss Morris acknowledged that she understood the Rule and confirmed her admission of the breach.
Rule 638 (3)(b)(ii) provides: A rider shall not:
(ii) strike a horse with a whip in a manner or to an extent which is excessive.
The Guidelines for Use of Whip provide:
Once a horse enters the final straight it can be hit with the drawn whip up to six times and then the rider should ride hands and heels for six strides before hitting the horse again with the drawn whip and continue this action until the 200 metres.
Mr McLaughlin demonstrated the incident using the available video footage. He said McMay was racing at the rear of the field on the home turn. Miss Morris was observed striking McMay approximately 13 times prior to the 200 metres. He said Miss Morris is required to ride her mount at least six strides before re-using the whip. He stated Miss Morris had used her whip after one stride and on another occasion after four strides. This was clearly in breach of the guidelines and the rule. He further added that Stipendiary Stewards had been advised to pay particular attention to breaches of this rule.
Miss Morris claimed the rule was vague in relation to the number of strides between the uses of the whip and needed clarification. She disputed the number of strikes with the whip claiming some were inside the 200m mark. She stated McMay was an older horse and difficult to get going.
Submissions for Penalty:
Mr McLaughlin told the committee that Miss Morris had a good record which showed no previous breach under this Rule in the last 12 months. He said that Miss Morris should be given credit for her admission of the breach and good record. He further added that this was at the low end.
Miss Morris stated that owners and trainers expected riders to compete and that in her opinion some were not familiar with the whip rule. She preferred a fine as opposed to a suspension.

The committee carefully considered all the evidence and submissions presented. We found in mitigation that Miss Morris admitted the breach and the fact that she has an excellent record under this Rule. We also considered the number of strikes (13) was at the lower end of the scale. Having viewed the video footage, we observed that the strikes were not continuous with some pauses.
The starting penalty for a breach of this rule is $500 or a two days suspension. The committee believes this breach can be dealt with by way of a fine only. Credit is given for Miss Morris’ excellent record of no previous breaches of this rule within the past 12 months, her early admission of the breach and that the breach is at the lower end of the scale. This would reduce the fine to $200. The only aggravating feature is the number of strikes with the whip and we increase the penalty to $250.
