Under Rule 876 (1) : Following the running of Race at the race meeting on Thursday 4 September 2008 at the Phar Lap raceway, a protest was lodged by Mr M Pitman, the trainer of RHYTHM MASTER, ridden by Ms C Tetzlaff. It was alleged that the horse O’RUBY, ridden by Mr J Misbah, placed third by the Judge, interfered with RHYTHM MASTER over the concluding stages of the race.
Under Rule 876 (1) : Following the running of Race at the race meeting on Thursday 4 September 2008 at the Phar Lap raceway, a protest was lodged by Mr M Pitman, the trainer of RHYTHM MASTER, ridden by Ms C Tetzlaff. It was alleged that the horse O’RUBY, ridden by Mr J Misbah, placed third by the Judge, interfered with RHYTHM MASTER over the concluding stages of the race.
--Present at the protest hearing was Mr Pitman, Ms Tetzlaff and Mr Misbah who was accompanied by Mr T R Moseley, a Licensed Jockey. The hearing was advised that the trainer of O’RUBY, Mr P Williams, was not interested in attending the protest hearing. This did give us some cause for concern as the protest was left to an Apprentice Jockey who does not have English as a first language, to defend the protest. The horse O’RUBY is owned by Parr Bloodstock Limited, and Stipendiary Steward Mr S Ching was unable to assist us as to whether or not there was a representative of Parr Bloodstock Limited on course.
--Mr T R Moseley, a Licensed Jockey, assisted Mr Misbah in the defence of the protest.
--Ms Tetzlaff alleged that as she was riding hard towards the finishing line, as she came up on the hind quarters of the winner, PONCHO, with O’RUBY racing at least one horse width clear of PONCHO, there was a gap available for her to take. She says that she endeavoured to take that gap but in the process O’RUBY closed on her and that in the last two strides she had to “stop riding by standing up in the saddle”.
--The margin between second and third was a half length.
--In reply, Mr Misbah, with Mr Moseley’s assistance, stated that he believed he kept a straight running line. Mr Moseley also pointed to the head-on film and said that he felt there was outward movement from all three horses, and at a critical point, some two strides from the line, O’RUBY “retaliated” by moving in slightly.
--Mr Pitman did not have any submissions to make with regard to the protest.
--Mr Ching was invited to comment on the protest. On the head-on film, he pointed to the approximate position of the finishing post and then related that to the allegation of interference. He said that in the Stewards’ opinion it was doubtful that RHYTHM MASTER would have beaten O’RUBY.
--DECISION
--We retired briefly to consider the evidence. We share Mr Mosley’s view that there was some outward movement by all three horses and that if there was contact, some two strides from the winning post, that it was minimal and as to whether or not it constituted interference in terms of Rule 871 (1) is a moot point.
--Therefore, having regard to the fact that we are in some doubt as to whether or not interference actually occurred, and the point at which the alleged interference took place, we do not believe that RHYTHM MASTER would have beaten O’RUBY, notwithstanding the margin of half a length. This view was reinforced by studying the film at a point when the field had approximately 100 metres to run and RHYTHM MASTER did not seem to be making any headway on O’RUBY which reinforces our view that RHYTHM MASTER would not have beaten O’RUBY.
--The protest was accordingly dismissed.
