Mr Prastiyou had admitted the breach and the charge was found proved.

Mr Prastiyou Apprentice Jockey’s Licence was suspended from the conclusion of racing on 6 November 2012 until the conclusion of racing on 14 November 2012, incorporating two South Island racing dates.

Facts:

Following the running of Race 6, WASHDYKE WONDERS 1600, an information was filed by Stipendiary Steward Mr McLaughlin, against Licensed Apprentice Jockey, Mr D Prastiyou, alleging a breach of Rule 638 (1) (d) in that Mr Prastiyou, as the rider of "Yazoom" in the race, "…when approaching the 200m Mr Prastiyou directed "Yazoom" outwards when not clear of "Corazana" and heavily bumping on three occasions.’"

Mr Prastiyou was present at the hearing and indicated that he admitted the breach. He was assisted at the hearing by Mr P Richards, Licensed Trainer.

Rule 638 provides as follows:

(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be: (d) careless.

Submissions for Decision:

Mr McLaughlin, with the assistance of the Race Video, illustrated how Mr Prastiyou’s mount "Yazoom" had been travelling inside "Corazana", ridden by Mr S Muniandy, approaching the final 200m in the home straight. He stated that both horses were racing at the rear of the leading bunch and that Mr Prastiyou’s mount "Yazoom" had no opportunity or clear room to improve either forwards or outwards. He stated that approx. 200m from the finish Mr Prastiyou shifted "Yazoom" outwards onto "Corazana", coming into contact with that horse on three separate occasions and eventually forcing "Corazana" outwards.

Mr McLaughlin submitted that Mr Prastiyou was travelling alongside and not sufficiently clear of Mr Muniandy’s mount when moving out. This resulted in "Yazoom" gaining clear racing room, which it was not entitled to.

On Mr Prastiyou’s behalf, Mr Richards submitted that it was a case of inexperience by Mr Prastiyou when he found his mount was travelling well with no room. He had shown an error of judgement by pushing his way out when making a gap to improve.

Mr McLaughlin acknowledged that Mr Prastiyou had shown inexperience on this occasion and would learn to wait for an opportunity to improve.

Submissions for Penalty:

Mr McLaughlin told the committee that Mr Prastiyou had just started race riding, was appearing before a judicial committee for the first time and had admitted the breach at the first opportunity. He considered a suspension of two race days would be an appropriate penalty.

Through Mr Richards, Mr Prastiyou accepted Mr McLaughlin’s submissions. He requested the committee to grant a seven day deferment to allow Mr Prastiyou to ride at Banks Peninsula on 4 November and Wingatui on 6 November. 

Reasons for Penalty:

The Committee determined a starting point of 5 days suspension as appropriate.  

We took into account Mr McLaughlin's submissions regarding Mr Prastiyou’s good record, his early admission and co operation with the Stewards. We also took into account that a suspension from 7 November would include Premier days at Canterbury.

Accordingly we considered a suspension of two South Island racing days as an appropriate penalty.
