Facts:
Mr Zarb requested a Ruling under Rule 647 (1) following the running of Race # 2 the OPHI VINEYARD & PORT FM MAIDEN 1200 “...alleging that R Hannam, the rider of TRUTH placed 4th by the judge, failed to weigh in. He was seeking the disqualification of Truth from the race...”
Rule 647 (1) provides as follows:
All riders in a Race shall weigh-in, unless excused from doing so by a Stipendiary Steward. A horse rider who does not weigh-in shall, in addition to any other penalty which may be imposed, be disqualified from the Race, unless the Stipendiary Stewards are satisfied:
(a) Rider’s failure to weigh-in, in accordance with this Rule, was justified by extraordinary circumstances, including if the Stipendiary Stewards are satisfied that, on account of accident or sudden illness, it is impracticable for him to weigh-in.
(b) Rider weighed out correctly with, and carried, his proper weight.

Mr Zarb said following the race he was informed by Stipendiary Steward Mr G Lachlan that Mr Hannam had not weighed-in. Mr Hannam’s mount TRUTH was officially placed 4th by the Judge.
Mr McLaughlin said he could not be sure if Mr Hannam weighed-in or not. He did not see Mr Hannam talking to anyone in the birdcage but did see Mr Hannam walking out of the jockey’s room.
Mr G Rowland said he marked each jockey in his race-book when they weighed-in and said Mr Hannam had not weighed-in after the race.
Mr Hannam said he believed he had weigh-in but could not be 100% sure.
Reasons for Decision:
The committee placed considerable weight on the evidence given by Mr Rowland - Clerk of the Scales. It was clear from his evidence that Mr Hannam had failed to weigh-in and accordingly the Request for disqualification under Rule 647 (1) is upheld.
