Accordingly, Mr Papier’s Apprentice Licence to ride is suspended for 4 riding days from the conclusion of racing on the 27 June up to and including racing on the 7 July 2021.
In addition to this suspension Mr Papier is fined $200.
Facts:
Following the running of Race 3 an Information was filed by Stipendiary Steward, Mr M Davidson, against Apprentice Jockey Mr W Papier in that he “permitted his mount CONFESSIONAL to shift inwards when not sufficiently clear of GAS MONKEY which was checked near the 1050 metres.”
Rule 638(1)(d) reads as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Papier had indicated on the Information that the breach of the Rule was admitted and he confirmed this at the hearing. Mr Papier stated he understood the charge and the Rule it was brought under.
Mr Davidson with the assistance of Mr Oatham used video coverage to show Mr Papier (CONFESSIONAL) after approximately 150 metres from the start, angle his mount inwards from a 3-wide position to the rail when only a bare length clear of GAS MONKEY (R Mudhoo) who was checked. Mr Davidson said GAS MONKEY was over racing which hasn’t helped the incident but Mr Papier has clearly been careless in this manoeuvre.
Mr Papier had nothing to add to Mr Oatham’s and Mr Davidson’s assessment.
Mr Pitman although admitting the interference was obvious felt Mr Mudhoo had room to relieve the pressure and should have gone with the flow.
Submissions for Penalty:
Mr Davidson stated Mr Papier had a clear record under the Rule and with his admission deserves some credit. He said the Stewards viewed this breach at top of a mid-range breach which the new Guidelines suggest a 5-day suspension plus a fine of $500. He said the Stewards believe a suspension in the 5 to 6 days as appropriate but a fine of this magnitude would be very harsh for any South Island Rider.
Mr Papier submitted a suspension of between 3 and 4 days would be sufficient.
Mr Pitman stated a 4-day suspension would be appropriate and conveyed the hardship of Apprentice Jockeys to the Committee.
Reasons for Penalty:
The Committee assessed this breach at the top end of mid-range and adopted the JCA revised Guidelines which provide a starting point of a 5-day suspension plus a fine of $500.
There are no aggravating factors here.
In mitigation Mr Papier has a very good record and has admitted the breach.
The Committee considered the addition of a fine in the vicinity of $500 would be disproportionate in this case.
With regard to the above factors the Committee considered a 4-day suspension plus a fine of $200 as an appropriate penalty in this case.
