Facts:
Following the running of Race 5, D'CASH DASH 1200, an information was filed by Stipendiary Steward Mr McLaughlin, against Licensed Apprentice Jockey, Mr R Doherty, alleging a breach of Rule 638 (1) (d) in that Mr Doherty, as the rider of “Urbana” in the race, "... allowed his mount Urbana to shift out when not clear of Sneaky (J Morris) whom had to check passing the 250 metres".
Mr Doherty was present at the hearing and indicated that he admitted the breach. He was assisted at the hearing by Mr Willie Harnett, Apprentice Jockey Mentor, Canterbury.
Rule 638 provides as follows:
(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be: (d) careless.
Submissions for Decision:
Stipendiary Steward, Mr McLaughlin, with the assistance of the race video, illustrated how Mr Doherty’s mount “Urbana” had been travelling inside “Sneaky” ridden by Miss Morris at about the 250 metre mark when Mr Doherty's mount moved out taking Miss Morris' racing line. Miss Morris had an established racing line and Mr Doherty had moved out when not sufficiently clear of “Sneaky” causing the check.
It was evident from the race video that Mr Doherty had crossed when not sufficiently clear of “Sneaky” causing that horse to check.
Mr Doherty accepted the Stipendiary Steward's submissions. He said that he had taken Miss Morris' racing line when not sufficiently clear.
On Mr Doherty's behalf, Mr Harnett submitted the horse inside Mr Doherty had rolled out to some extent and Mr Doherty's mount had gone with it. He accepted however that Mr Doherty had ridden carelessly.
Mr McLaughlin submitted that while both Mr Doherty's mount and the horse inside him were running similar lines, there was clear air between the horses at all times.
Submissions for Penalty:
Mr McLaughlin told the committee Mr Doherty had a previous suspension imposed on 10th December 2011 for careless riding. He considered the current breach to be of low severity and submitted a penalty of 2 days suspension would be appropriate. He confirmed Mr Doherty confined himself to riding at South Island meetings.
Through Mr Harnett, Mr Doherty accepted Mr McLaughlin’s submissions. He requested a deferment of any suspension to allow him to meet commitments over the next week. The Committee adjourned to allow Mr Doherty to confer with a trainer over his riding commitments. On reconvening the Committee imposed a 2 day suspension on the basis of Mr Doherty confining himself to riding in the South Island.

The Committee determined a starting point of 5 days suspension as appropriate.
We took into account Mr McLaughlin's submissions regarding Mr Doherty's comparatively good record, the low severity of the interference caused and Mr Doherty's early admission and co operation. We also took into account Mr Harnett's submissions concerning the horse racing inside Mr Doherty rolling off the rail and possibly contributing to Mr Doherty's mount moving up the track towards Miss Morris' racing line.
Accordingly we considered a suspension of 2 South Island racing days as an appropriate penalty.
