Facts:
Following the running of Race 4, ROLL ON SPRING MAIDEN SPRINT 1200, an information was filed by Stipendiary Steward Mr McLaughlin, against Licensed Apprentice Jockey, Miss C Barnes, alleging a breach of Rule 638 (1) (d) in that Miss Barnes, as the rider of “Little Faith” in the race, “…allowed her mount “Little Faith” to shift inwards when not clear of “Our Zulu Girl” (R Black) which was dictated onto “Taranto” (R Doherty) whom had to check passing the 1100 metres”.
Miss Barnes was present at the hearing and indicated that she admitted the breach. She was assisted at the hearing by Mr P Richards, Licensed Trainer.
Rule 638 provides as follows:
(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be: (d) careless.
Submissions for Decision:
Stipendiary Steward, Mr McLaughlin, with the assistance of the race video, illustrated how Miss Barnes' mount “Little Faith” had been travelling outside “Our Zulu Girl”, ridden by Miss Black, at about the 1100 when she allowed her mount to move down putting pressure on “Our Zulu Girl”, which dictated onto “Taranto” ridden by Mr Doherty. Mr McLaughlin referred to the resulting check on “Taranto” as being nasty. Mr McLaughlin submitted that Miss Barnes was travelling alongside and not sufficiently clear of Miss Black's mount when moving down.
It was evident from the race video that Miss Barnes had moved down when not sufficiently clear of “Our Zulu Girl” which in turn was forced down onto “Taranto” causing what appeared to be a significant check to that horse.
Miss Barnes accepted the Stipendiary Steward's submissions. She told the Committee that her horse had been racing greenly.
On Miss Barnes' behalf, Mr Richards submitted “Taranto” was having its first start, was green, and over reacted to the interference making the incident look more serious than it was. Mr McLaughlin acknowledged that this was a possibility.
Submissions for Penalty:
Mr McLaughlin told the committee that Miss Barnes started race riding in March, having ridden in approximately 60 races, had ridden 7 winners, and had a clean record. He considered the breach to be at a low level of severity and a suspension of 2 race days would be an appropriate penalty. Mr McLaughlin told the committee Miss Barnes confined herself to riding in the South Island.
Through Mr Richards, Miss Barnes accepted Mr McLaughlin’s submissions. He requested a deferment of any suspension to allow her to meet race riding commitments over the next week.
Reasons for Penalty:
The Committee determined a starting point of 5 days suspension as appropriate.
We took into account Mr McLaughlin's submissions regarding Miss Barnes' good record and the low severity of the interference caused, her early admission and co operation. We also took into account Mr Richard's submission, supported by Mr McLaughlin that “Taranto” through inexperience in his first race may have over reacted when the interference occurred, this making the interference look more serious.
Accordingly we considered a suspension of 2 South Island racing days as an appropriate penalty.
