As Ms Wynne admitted the breach it is proved.

Penalty:

Ms Wynne is suspended for 3 riding days from the close of racing on Friday 29 August 2014 to the close of racing on Thursday 11 September 2014. – the 3 days being Otaki (4 September), Riccarton (6 September) and New Plymouth (11 September).

Facts:

Following the running of race 3, the “Onceponatime and Patapan 1600 Rating 75”, Information A5722 was filed by Stipendiary Steward Mr J McLaughlin under Rule 638(1)(d). The Information stated “S Wynne permitted her ride “Mychino” to shift outwards near the 400 metres when not clear of “El Bee Dee” which had to be checked”. Ms Wynne signed the Information stating she admitted the breach and at the beginning of the hearing confirmed that was correct and also that she understood the rule under which he was charged.

Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.

Submissions for Decision:

Mr McLaughlin asked Mr McIntyre, using the side-on film of the race at the beginning of the bend into the home straight, to highlight Ms Wynne racing approximately 3 horse widths off the fence. Mr McLaughlin said as Ms Wynne rounded the bend into the straight she could be seen to look to her outside before she moved out into the line of Ms Williams on “El Bee Dee” who was checked. He used another camera view to show that as Ms Wynne moved out she was barely a length in front of Ms Williams. He said Ms Williams had told him she had anticipated that Ms Wynne might move out as she did. Mr McLauglin said the film clearly showed Ms Williams had to check her mount and change ground and Ms Wynne was fortunate that Ms Williams was an experienced rider as one less experienced may have been placed in greater difficulty than Ms Williams was.

Ms Wynne said she did look to her outside before moving out and saw Ms Williams but thought she was not going very well and decided to move out to get a clean run. She said she was not aware of having caused the check until she was called in by the stewards after the race to view a replay of the incident. Ms Wynne said Ms Williams came up on her outside quicker than she had anticipated which resulted in her causing the check to her.

Mr Coulbeck agreed Ms Wynne was not the required distance clear of Ms Williams when she moved out and that this happened because Ms Wynne thought Ms Williams was not going as good as her as they rounded the home turn.

Submissions for Penalty:

Mr McLaughlin said Ms Wynne had breached the careless riding rule twice in the past 12 months – on 19 April when she received a 2 day suspension and on 26 June when she had received a 3 day suspension. He said that Ms Wynne rode throughout the South Island and in recent weeks had been riding in the Central Districts. He said Ms Wynne had clearly misjudged the distance she was in front of Ms Williams as she rounded the home bend and said the stewards classed the severity of the incident in the low range. He pointed out, however, that the actions of Ms Williams in anticipating that Ms Wynne might possibly move out as she did meant that a more serious incident had been avoided. He submitted that a penalty of 2 South Island riding days was an appropriate penalty.

Ms Wynne confirmed that she had recently been riding in the Central Districts and that it was her intention to continue to do so on a regular basis in the future. She said she had been riding for Mr K Myers in the South Island and he had told her he would be providing rides for her in the Central Districts. She also said she had also been approached by 2 other trainers at Wanganui last weekend to ride for them in upcoming Central Districts meetings. She confirmed that if she were to be suspended she wished to seek a deferment of 7 days to enable her to ride at Ashburton on 29 August.

Reasons for Penalty:

The Committee has reviewed films of the incident and taken into account all the submissions made. The films clearly show that as Ms Wynne rounded the bend into the straight near the 400m mark she moved out when not sufficiently clear of Ms Williams who was forced to check and change ground.

The JCA’s Penalty Guidelines state the starting point for a breach of the careless riding rule is 5 riding days. We have taken into account Ms Wynne’s admittance of the breach and also that this is her third breach of this rule in the past 4 months. We believe the severity of the interference in the low to mid range and agree with Mr McLauglin that Ms Williams, in anticipating that Ms Wynne might move out as she ended up doing, did reduce the impact on her although even then she did receive a check and have to change ground.

We have also reviewed the JCA’s list of penalties imposed under this Rule in recent months to ensure, as best we can, a general consistency with those decisions. We accept that Ms Wynne is intending to ride in the Central Districts as often as possible in the future and that any suspension imposed should reflect that.

The Committee believes the interference caused must be reflected in an appropriate penalty which we have decided is a period of suspension. From a starting point of 5 days we have reduced that by 1 day because Ms Wynne has admitted the breach, and a further day because the severity of the breach is towards the low end and that up until recently Ms Wynne has been a South Island only rider. The Committee did consider whether the two breaches in the previous 4 months justified an additional day being added to the suspension but in the end decided we would not do so.

Ms Wynne’s request for a deferment of 7 days is agreed to in terms of Rule 1106(2).
