Facts:
Following the running of Race 8, Equine Veterinary Services 2200m, an Information was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Jockey (Class A), Mr A Balloo alleging that Mr Balloo, as the Rider of VERMONT in the race, “permitted his mount to shift inwards when not sufficiently clear of ANYTHINGCOULDHAPPN (K Chowdhoory) which was checked near the 2000 metres”.
Mr Balloo was present at the hearing of the Information and he indicated that he denied the breach.
Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Mr Davidson had Chief Stipendiary Steward, Mr J P Oatham, show head-on and side-on video replays of the first 200-300 metres of the race from the 2200 metres start. Mr Oatham pointed out VERMONT, ridden by Mr Balloo, starting from barrier 6 in the 10-horse field, ANYTHINGCOULDHAPPN, drawn 3, and WANNABE ‘N’ PARIS drawn barrier 2.
Mr Oatham said that, shortly after the start, Mr Balloo angled his mount inwards. He demonstrated, on the side-on and head-on video replays that when Mr Chowdhoory had to check his mount quite sharply off Mr Balloo’s heels, Mr Balloo would have been no more than a bare length clear of Mr Chowdhoory. Mr Balloo continued to shift inwards and continued to take Mr Chowdhoory in on to WANNABE ‘N’ PARIS, ridden by Miss Barnes. At no point did Mr Balloo attempt to relieve the pressure but continued to ride forward and shift inwards, putting the other two Riders, in particular Mr Chowdhoory, in difficulty for some distance.
Mr Chowdhoory was called to give evidence to the hearing. He said that he was the Rider of ANYTHINGCOULDHAPPN in the race and that he received pressure from his outside, forcing him to check his mount. The pressure came from Mr Balloo, he said. Mr Davidson pointed out on the video replay, Mr Chowdhoory turning his mount’s head in. This was to avoid heels, Mr Chowdhoory said. He was taken inwards for some distance, onto Miss Barnes, he said. When he first had to turn his horse’s head in, Mr Balloo’s mount was no more than a half-length clear. He agreed with Mr Davidson’s observation that he and Miss Barnes had been shifted, from 4-wide and 3-wide respectively to one-out and on the rails.
Mr Balloo declined the opportunity to cross-examine Mr Chowdhoory. It was explained to him by the Committee that he was thereby deemed to accept the version of events given by Mr Chowdhoory. Mr Balloo said that when he checked to his inner he believed that he was “kind of clear”, and did not see Mr Chowdhoory. He had wished to view the side-on video replay to see how clear he was and he now accepted that he was not clear. He sought leave to change his plea and admit the charge.
Submissions for Penalty:
Mr Davidson told the hearing that Mr Balloo has two breaches of the Careless Riding Rule on his record – on 30 January at Riccarton (4 days and $350) and on 6 March at Otago (6 days and $350, mid-range).
Mr Davidson said that Stewards were suggesting a suspension of 4-5 days and a “minimal fine” for what they saw as a “slightly lower than mid-range” breach.
Mr Balloo repeated that he had not seen Mr Chowdhoory. He had been “rolling”, and Mr Chowdhoory “kicking up” may have contributed to the interference, he submitted.
Mr Balloo said that had taken rides at the Otago RC meeting on 28 May and sought a deferment until after that meeting.
Reasons for Penalty:
The Committee regards the breach as being in the low-mid range. The NZTR Penalty Guidelines provide a starting point of a $500 fine and a 5-day suspension for a mid-range breach. Mr Balloo’s riding record, the Committee assesses as neutral. He changed his plea, mid-hearing, to admit the breach but no discount is being given for that factor, as this was a clear case of careless riding. However, to reflect that the breach was slightly lower than mid-range, the Committee is able to reduce the fine suggested by the Penalty Guidelines for a mid-range breach.
