The protest was upheld and MARKS was relegated to 5th placing. Consequent upon the relegation, the amended result for the race is as follows:

1st   2 Hurikin
2nd  5 Gallant Dan
3rd  8 Gild the Lily
4th 11 Colonel Anne
5th   6 Marks

It was ordered that dividends and stakes be paid in accordance with that amended result.

Facts:

Following the running of Race 1, Three Valleys Sales Draft Maiden Sprint, an information instigating a protest was filed by Licensed Jockey (Class A), Mr C W Johnson, alleging that MARKS (K C Wong), placed 4th by the judge, interfered with the chances of COLONEL ANNE, ridden by him, placed 5th by the judge, alleging “interference in the straight”.

Mr Johnson was present at the hearing of the information representing the connections of COLONEL ANNE. The connections of MARKS were represented by its jockey, Mr K C Wong, who was assisted by Licensed Trainer (Class A), Mr N F Ridley, trainer of MARKS.

Rule 642 provides as follows:

(1) If a placed horse or its Rider causes interference within the meaning of Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

Mr Johnson said that he had been racing in 2nd place outside of MARKS, which had led the field turning for home. He said that, early in the straight, he could tell that Mr Wong was having “a bit of trouble”, with his mount hanging. He tried to get alongside MARKS to help it to run straight but he was unable to get round it, he said. MARKS kept running out, Mr Johnson said, and he had to switch back inside that runner.

Side-on and head-on video replays were shown to the hearing. Mr Johnson said that, shortly after turning into the straight, two other runners came up on his outside. He was hampered by Mr Wong’s mount moving out and was unable to ride his own horse forward. Mr Johnson said that, when Mr Wong’s horse began to move out, he was up on the hind quarters of that horse. He eventually had to ease back and shift to the inside of Mr Wong, he said. He lost ground and momentum in doing so. He believed that when he shifted back to the inside of MARKS he was going to beat that horse but MARKS had kept going, Mr Johnson said.

Mr Wong said that he had been instructed to “follow the leader” after the start. However, the horse had “run strongly” and taken the lead prior to the turn. From that point, he attempted to keep the horse close to the rail, but it kept hanging out, he said. He heard Mr Johnson call to him. He gave his mount one strike with the whip to endeavour to straighten it. Approaching the finishing line, he heard jockey D M Walsh (KEEPITASECRET), which was finishing on his outside, call out to him so he eased his horse near the line. He said that he had asked Mr Walsh before the race as to how best to ride the horse. Mr Walsh told him to be careful. At Kumara (on 11 January 2014) the horse had hung out, Mr Wong said.

Mr Ridley accepted that there had been interference caused to Mr Johnson’s mount. He submitted that Mr Johnson’s mount had come to the end of its run near the line after getting up beside MARKS.

Mr N G McIntyre, Co-Chief Stipendiary Steward, said that the Stewards supported Mr Johnson’s protest. Mr Johnson had been unable to ride his horse with any vigour between the 250 and the 150 metres. He had lost ground and some momentum when he was forced to change ground. Mr McIntyre referred to the margin of a long neck at the finish. 

Reasons for Decision:

The Committee was satisfied that MARKS had caused interference to COLONEL ANNE in the home straight, as alleged, by shifting ground outwards and hampering COLONEL ANNE and forcing it over extra ground for a distance of approximately 100 metres, with Mr Johnson eventually having to change ground to the inside of MARKS to obtain a clear run. In doing so, COLONEL ANNE lost significant ground, 1 ½ to 2 lengths in the Committee’s estimation, and momentum at a critical time in the race when it was just mounting its challenge.

The margin of a long neck between the two horses at the finish was a significant factor in the Committee’s finding that COLONEL ANNE would have finished ahead of MARKS had the interference not occurred.
