Decision:
Following the running of race number 4 an information was lodged by the Stipendiary Stewards alleging a breach of rule 858 (1) (a) in that Mr Holmes failed to weigh in after the race as required by the Rules of Racing.

At the outset of the hearing the rule was read to Mr Holmes who confirmed that he understood it. He also confirmed that he admitted the breach of the rule. Accordingly, the charge is found proven.

Mr Davidson for the Stipendiary Stewards said that after the running of race 4 it was noted that Mr Holmes had failed to weigh in and that he spoke to Mr Holmes in the jockeys room. Mr Holmes admitted to Mr Davidson that he failed to weigh in and that it was an oversight on his part. Mr Holmes confirmed the details of the conversation between Mr Davidson and himself.

In regard to penalty the Stipendiary Stewards submitted that a fine was appropriate and that as no other party was effected they were not seeking the forfeiture of Mr Holmes’ riding fee.

Mr Holmes for his part said that when he last rode in New Zealand some 10 to 12 months ago the new requirement for all jockeys to weigh in had been put in place. Over the last 10 months he had been riding in Australia where riders of horses not finishing in stake bearing positions were not require to weigh in. He confirmed that he was aware of the rule and it was simply an oversight on his part.

The Committee after giving consideration to the submissions of both parties agreed that a fine only of this occasion is appropriate and after taking into account the early guilty plea by Mr Holmes, his frankness at the hearing and noting that no other party was affected imposes a fine of $125.00.
