As Mr Yatim, had admitted the breach, the charge was found proved.
Penalty:
Accordingly, Mr Yatim’s Class B Jockeys licence is to be suspended from the conclusion of racing on Sunday, 4 June up to and including 11 June 2017. This suspension encompasses the days racing at Riccarton on 7 June and Waimate on 11 June 2017.
Facts:
Following the running of Race 8, the Johnny Walsh Stayers 2100m, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Class B Rider, Mr R Yatim, alleging careless riding in that he directed his mount HELL BOUND outwards making firm contact with FULL OF EXCUSES near the 350metres.
Rule 638(1)(d) reads as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Yatim had indicated on the Information that this breach of the Rules was admitted and he confirmed this at the hearing. Mr Yatim also agreed that he understood the charge and the Rule it was brought under.
Mr Yatim was assisted at the hearing by NZTR Apprentice Mentor, Mr W Harnett.
Mr McLaughlin with the assistance of Chief Stipendiary Steward, Mr J Oatham, gave evidence and used video coverage to show that shortly after entering the home straight and approaching the 350m, HELL BOUND, ridden by Mr Yatim, was racing on the rail and in the trail of the leader with FULL OF EXCUSES, ridden by Mr J Lowry to its outer in a 2-wide position. He said a gap presented itself on the outside of the leading horse and Mr Yatim shifted out to improve into that available racing room. Mr Oatham stated that there was sufficient room for Mr Yatim to improve between FULL OF EXCUSES and the leading horse but that Mr Yatim had allowed his mount to continue on outwards making solid contact with Mr Lowry’s mount which was buffeted for a number of strides. Mr Oatham described the level of Mr Yatim’s carelessness as being towards the lower end.
Mr Harnett stated that Mr Yatim has made an awkward manoeuvre when shifting out. He said Mr Yatim had said that the horse was hanging during the running.
Mr Yatim stated that the horse was racing in a new bit and found the horse quite difficult to ride with.
Mr Harnett also stated that the films showed Mr Lowry’s horse has been dictated in slightly by the outside runner which happened as the outward movement by Mr Yatim was occurring. He said that this has contributed somewhat to the incident.
Submissions for Penalty:
Mr McLaughlin stated that Mr Yatim’s penalty record over the previous 12 months was clear in regard to this rule and submitted that the breach was at a lower level. He submitted that a 2-day suspension be considered as penalty in this case.
Mr Yatim made no submissions in regard to penalty.
The matter of deferment was discussed with Mr Yatim stating through Mr Harnett that he did not have any riding commitments after Dunedin on 4 June, where the riders were already declared, and asked that any suspension imposed start after that meeting.
Reasons for Penalty:
The JCA penalty Guide suggests a 3-day suspension as the appropriate penalty for a mid-range breach of this rule. The Committee determined that this breach falls at the mid to low-range of offending and accordingly, have adopted the 3-day starting point for a South Island jockey. As there are no aggravating factors in this case an uplift in penalty is not required. Mitigating factors are Mr Yatim’s good record and his admission of the breach which we determined afforded him a discount which we set at 1 day.
We therefore determined that a 2-day suspension was an appropriate penalty in this case.
