Following the running of Race 4, Dennison’s Joinery Sprint, an information instigating a protest was filed by Stipendiary Steward, Mr S C Ching, against ARCTIC ACE (2) (I Khairil), placed 5th by the judge, alleging that it caused interference to OUR GENES (3) (C W Johnson), placed 6th by the judge, over the concluding stages.

--Mr I Khairil, rider of ARCTIC ACE, and his employer Mr S A Marr, were present at the hearing of the information and indicated that they were authorised to represent the connections of ARCTIC ACE. Mr Ching confirmed that Mr A W Prendergast, trainer of ARCTIC ACE, had informed him that he was happy to be represented by Messrs Khairil and Marr at the hearing of the protest.
--There was a 5th stake of $300 payable in the Race.
--Mr Ching had Mr M R Davidson, Stipendiary Steward, show video replays of the concluding stages of the Race. Mr Davidson pointed out ARCTIC ACE go for a run between TURF FIRE (K Williams) and OUR GENES. The latter runner was crowded by the inward movement of ARCTIC ACE, Mr Ching alleged, and the interference to OUR GENES was sufficient to deprive it of the opportunity of finishing in 5th placing. It was “unbalanced and pushed around” by ARCTIC ACE and the margin between 5th and 6th at the finish was a half neck.
--Mr Johnson said that, approximately 100 metres from the finish, he had clear running in front and was buffeted from the outside. Mr Johnson said that the interference did not help his chances – without it, he may have finished 5th.
--Mr Khairil said that he was in trouble and his mount was hanging in and then the horse in front of him “shifted in a little bit”. His mount continued to lug in and he attempted to straighten it. Mr Khairil admitted that OUR GENES had received interference as a result.

Mr Marr said that it was clear that there had been interference to OUR GENES but, he said, the half neck margin “flattered” OUR GENES. ARCTIC ACE had gone to the line under a hold and had run out of racing room. The same could be said for OUR GENES, Mr Ching submitted.
Mr M R Pitman, trainer of OUR GENES and who was present at the hearing, submitted that there had been clear interference by ARCTIC ACE to OUR GENES.
--The Committee was satisfied, firstly, that ARCTIC ACE had caused interference to OUR GENES and, secondly, that OUR GENES would have finished ahead of ARCTIC ACE had such interference not occurred. Relevant factors in arriving at those findings were the degree of interference suffered to OUR GENES – the horse had clear running but was then buffeted and unbalanced at a critical point in the Race and lost momentum – and the half neck margin between ARCTIC ACE and OUR GENES at the finish.
--Accordingly the protest was upheld and ARCTIC ACE was relegated to 6th placing. Consequent upon the relegation, the amended placings for the Race are as follows:

4th 7 All Spice
5th 3 Our Genes
6th 2 Arctic Ace
