Following the running of Race 8 at the South Canterbury Racing Club’s meeting on 14 September 2008, Mr I Khairil was charged pursuant to Rule 530 (2) (b) with excessive use of the whip on his mount SPEEDWAY between the 400 and 200 metre mark.

--Stipendiary Steward Mr Davidson demonstrated the incident on the video film which showed Mr Khairil using his whip some twelve to thirteen times between the 400 and 200 metre mark.
--Mr Khairil pleaded guilty to the charge and the charge is therefore deemed to be proved.

PENALTY DECISION
--With regard to penalty, we make the comment that this is not the worst case of excessive use of the whip that we have seen but, notwithstanding that, the use of the whip was still well outside the well-published guidelines.
--We have taken into account the fact that this is the first time that Mr Khairil has been charged with this offence. We also give him credit for his early guilty plea. There has been a recommendation by the Stipendiary Stewards that a fine be imposed. We have given consideration to that and agree.
--The fine to be imposed Mr Khairil is $175.00.
