As Mr Wahab, had admitted the breach, the charge was found proved.
Penalty:
We therefore determined that Mr Wahab’s Class B Jockeys licence be suspended from the conclusion of racing today, Friday 14 July up to and including 5 August 2017. This suspension encompasses the meetings at Oamaru on 23 July, Timaru on 28 July and Riccarton on 5 August 2017.
Facts:
Following the running of Race 6, the Shaweigh Maiden Mile 1600m, an Information was filed by Stipendiary Steward, Mr M Davidson, against Class B Rider, Mr S Wahab, alleging careless riding in that when riding GREY GHOST, he rode carelessly when riding with the whip after GREY GHOST had shown tendency to lay inwards throughout the run home, clipping a heel near the 175m.
Rule 638(1)(d) reads as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Wahab had indicated on the Information that this breach of the Rules was admitted and he confirmed this at the hearing. Mr Wahab also agreed that he understood the charge and the Rule it was brought under. Mr Wahab was assisted at the hearing by his employer Mrs Parsons and NZTR Apprentice Mentor, Mr D Walsh.
Mr Davidson, with the assistance of Stipendiary Steward, Mr J McLaughlin, gave evidence and used video coverage to show that as the field was entering the home straight, GREY GHOST, ridden by Mr Wahab, was widest on the track and improving. Mr McLaughlin pointed out GREY GHOST who was laying inwards, shift inwards initially and make contact with another runner when Mr Wahab was using the whip. He said Mr Wahab then stopped riding and took control of his mount. Mr Wahab then drew and used the whip again when GREY GHOST was still laying in, resulting in that horse shifting in abruptly and clipping the heel of another runner. Mr Davidson submitted that Mr Wahab’s carelessness was at a mid to high level. He stated that Mr Wahab should not have drawn the whip with GREY GHOST who showing a tendency from the home turn to lay in and should have concentrated on keeping his mount on a true line.
Submissions for Penalty:
Mr Davidson stated that Mr Wahab’s penalty record over the previous 12 months showed a 2-day suspension for careless riding on 26 December 2016 at Dunedin and submitted that the breach was at a mid to high level. He submitted that a 3-day suspension be considered as penalty in this case.
Mr Wahab made no submissions in regard to penalty.
The matter of deferment was discussed but deemed not an option as the next relevant meeting in the South Island was 9 days ahead.
Reasons for Penalty:
The JCA Penalty Guide recommends a 3-day suspension as the appropriate starting point for a mid-range breach of this rule for a South Island rider. The Committee determined that this breach falls at the mid to high-range of offending and accordingly, have adopted a 4-day starting point. As there are no aggravating factors in this case an uplift in penalty is not required. Mr Wahab’s penalty record showed a 2-day suspension nearly 7 months previous which the Committee were prepared to consider as a neutral factor. Mitigating factors are Mr Wahab’s admission of the breach which we determined afforded him a discount which we set at 1 day. We therefore determined that a 3-day suspension was an appropriate penalty in this case.
