As Mr Jogoo had admitted the breach, the charge was found proved.

Accordingly, we suspend Mr Jogoo’s licence from the conclusion of racing on the 25th October 2017 up to and including racing on the 5th November 2017.

Facts:
Following the running of Race 6 the Onceuponatime Handicap, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Apprentice Jockey Mr G Jogoo, the rider of MYSTERY MAN, alleging careless riding in that he “permitted his mount to shift outwards when not sufficiently clear dictating TRAVEL WISE outwards into the line of DIRECTOR which clipped a heel and blundered near the 250 metres.”
Rule 638(1)(d) reads as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Jogoo had indicated on the Information that this breach of the Rules was admitted and he confirmed this at the hearing. Mr Jogoo also agreed that he understood the charge and the Rule it was brought under.
Mr Jogoo was assisted at the hearing by Licenced Trainer Mrs K Parsons, his employer.
Mr Oatham, gave evidence and used video coverage to show Mr Jogoo, MYSTERY MAN, leading the field entering the straight. Mr Oatham said at this stage Mr Jogoo was two wide. He showed from that point MYSTERY MAN drifting out another three horse widths which dictated TRAVEL WISE, (Miss Jonker) into the line of DIRECTOR, (Mr Johnson) who was making a run to the outside. The video clearly showed DIRECTOR blunder as it clipped a heel and Mr Jogoo only ¾ of a length clear of Miss Jonker when he allowed his mount to shift outwards.
Mr Jogoo submitted he didn’t realise he had drifted so far from the rail until he was shown the film.
Submissions for Penalty:
Mr McLaughlin stated this was Mr Jogoo’ s second breach today having been suspended from an incident in race 4 and had one other breach at Ashburton in March of this year. He said the Stewards saw this as a Mid to Low level breach and a 2 to 3-day suspension be considered as a penalty.
Mrs Parsons submitted that she felt fully responsible because she had trialled MYSTERY MAN without blinkers and had forgotten the horse was to race in them. This she said was why the horse was stirred up at the start and during the race and consequently why it was out on its feet at the time of the incident.
Reasons for Penalty:
In determining penalty, we have taken the JCA Penalty Guide starting point for a South Island rider which is a three-day suspension.
The aggravating factor is this is Mr Jogoo’s second breach of the rule today. We therefore uplift the penalty one day to a four-day penalty.
In mitigation we can afford a discount of one day for Mr Jogoo’s ready admission of the breach. We consider a 3-day suspension is an appropriate penalty in this case.
Deferment wasn’t an option because this suspension would be a continuation of Mr Jogoo's suspension earlier in the day.
