We therefore determined that Mr Jogoo’s licence to ride be suspended from the conclusion of racing on the 15th October 2017 up to and including racing on 25th October 2017. This suspension encompasses the days racing at:

Wingatui on 25th October 2017
Facts:
Following the running of Race 4, the Equine Veterinary Services Sprint 1200, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Apprentice Jockey Mr G Jogoo, the rider of RESIDENTIAL, alleging careless riding near the 1000m, in that he permitted his mount to shift inwards causing OPIHI RANGER (J Morris), to be checked.
Rule 638(1)(d) reads as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Jogoo had indicated on the Information that this breach of the Rules was admitted and he confirmed this at the hearing. Mr Jogoo also agreed that he understood the charge and the Rule it was brought under.
Mr Jogoo was assisted at the hearing by Licenced Trainer Mrs K Parsons, his employer.
Mr Oatham, gave evidence and used video coverage to show that approaching the 1000m Mr Jogoo, who was racing three wide in mid-field moved his mount inwards across OPIHI RANGER (J Morris) who was two wide, when not his length and another length clear.
Mr McLaughlin estimated RESIDENTIAL (Mr Jogoo) was only a bare length clear and this manoeuvre resulted in the check to Miss Morris’ mount.
Mr Jogoo entered no submissions.
Submissions for Penalty:
Mr McLaughlin stated Mr Jogoo had a previous breach of this rule in March 2017 at Ashburton. He said this breach was at a low level and that Miss Morris had perhaps lost a length in the incident. He submitted a two-day suspension be considered as a penalty.
Mr Jogoo made no submissions on penalty.
Reasons for Penalty:
In determining penalty, we have taken the JCA Penalty Guide starting point for a South Island rider which is a three-day suspension. Despite Mr Jogoo’s record showing a previous suspension earlier this year we regard his record as neutral. There are no aggravating factors to consider an uplift in this case.
In mitigation we can afford a discount of one day for Mr Jogoo’s ready admission of the breach. We consider a 2-day suspension is an appropriate penalty in this case.
When deferment was discussed it was discovered that riders were already declared for the Winton meeting on the 15th of October 2017 and the suspension would start immediately after, as Mr Jogoo advised he had confirmed rides at the meeting.
