As Ms Williams has admitted the charge, it is deemed to be proved.

Taking into account all matters, we consider that a fine of $175 should be imposed.

Facts:

Ms Williams elected not to be present at the hearing of the information.
Mr McLaughlin demonstrated the incident to the hearing by reference to the side-on camera. As the field entered the straight, Ms Williams was a clear leader by some 4 to 5 lengths. She drew her whip and struck her mount between 9 and 11 times before the 200 metre mark without pausing, and returning her hand to the whip rein, as required by the "Use of the whip" guidelines.  She went on to win the race.

Submissions for Penalty:

Mr McLaughlin advised the hearing, that Ms Williams has not been charged with a breach of this rule in the past twelve months. He felt that it was an aggravating feature that Ms Williams considered it necessary to use her whip in such a manner when she had such a clear lead on the rest of the field.  Mr McLaughlin submitted that a fine in the region of $200 should be imposed.

Reasons for Penalty:

Ms Williams has a good record in terms of this rule, not having been charged with a breach of the rule during the last 12 months. This committee notes that for similar offending, other jockeys who have demonstated a good record had fines imposed in the region of $175. We did not consider Ms Williams breach of the rule to be at the higher end of the scale, and furthermore, it was reasonably difficult to determine the position of her mount in relation to the 200 metre mark, in terms of counting the number of whip strokes. We accept Mr McLaughlin's submission that having regard to the healthy lead that Ms William's mount had at the time, that as such, it was an aggravating feature of the breach to use her whip in such a manner.
