Facts:
Following the running of Race 1, the Jo McGartland Memorial Open Hurdle, an Information was filed by Stipendiary Steward Mr J McLaughlin against Licensed Jockey Mr A Kuru, alleging a breach of Rule 638(3)(b) in that he used his whip excessively on JAMIE LEE.
Rule 638(3)(b) reads as follows:
“(3) A rider shall not:
(b) strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper;
Mr Kuru had indicated on the Information that the charge was admitted which he confirmed at the hearing. He also confirmed that he understood the Rule he was being charged with.
Mr McLaughlin gave evidence and produced video replays, with the assistance of Senior Stipendiary Steward, Mr J Oatham. The video replays showed Mr Kuru riding JAMIE LEE, who was in last place approaching the 600m. Mr McLaughlin stated that Mr Kuru used his whip on 11 occasions without going back to the whip rein as required by the Rule guidelines, between the 600m and 400m. Mr Kuru, he said had also used his whip on several occasions, again in the straight, when JAMIE LEE was still in last place and not in contention.
Mr Kuru did not object to the Stewards' evidence and made no submissions on the facts.
Submissions for Penalty:
Mr McLaughlin stated that Mr Kuru had a clear penalty record in regard to the Rule. He also stated that Mr Kuru had admitted the breach at the first opportunity. Mr McLaughlin submitted that a fine of $200 be considered as penalty in this case.
Reasons for Penalty:
In determining penalty the Committee took the JCA Penalty Guide recommendation of $300 for a first offence as a starting point. We were able to give a discount of $50 for Mr Kuru’s clear penalty record and a further discount of $50 for his frank admission of the breach. We therefore decided that an appropriate penalty was a fine of $200.
