Mr Lammas had admitted the breach and the breach was found proved.

Penalty:

Mr Lammas’ Jockey’s Licence is suspended from the conclusion of racing on the 15th July up to and including the 20th July 2013.  

Charge:

Rule 330 (3) (c) provides: A rider shall not fail to ride a horse at the weight at which it is handicapped to carry.

Mr Lammas was present at the hearing and indicated that he admitted the breach.   

Facts:

Following race 5, the Catering South Canterbury Dash Rating 85 1200, an information was filed pursuant to Rule 330 (3) (c). The Informant, Mr McLaughlin, alleged that...”Mr Lammas failed to make the contracted weight for THAT’SOUREXCUSE.”

Submissions for Decision:

Mr McLaughlin told the Committee that when Mr Lammas weighed out for Race # 5 he weighed out between 0.75kg and 1kg over the contracted weight. THAT’SOUREXCUSE was carded for a handicapped weight of 54.5kg, which Mr Lammas could not make. Mr McLaughlin stated that Mr Lammas had accepted the ride at 54.5kg, but that prior to race day had spoken to the connections and had requested he ride 0.5kg overweight. The connections had agreed to that request. However, on race day Mr Lammas had failed to make 55kg and had to be replaced as the jockey on THAT’SOUREXCUSE.

Mr Lammas said he was only 0.25kg overweight on the day. He had tried his best to lose the weight but had not been able to. 

Submissions for Penalty:

Mr McLaughlin stated that Mr Lammas had four previous breaches of the same rule, since March 21st this year. This was his fifth breach since then. He said the first two, March 21st at Wingatui and March 30th at Riverton had been dealt by way of a Minor Infringement Notice. The breaches on June 13 at Wanganui and July 1st at Matamata had been dealt with by a Breach of the Rules. Mr Lammas had been fined on each occasion with the fines increasing in size each time. 

He said the breach of Rule at Matamata involved exceptional circumstances where Mr Lammas had arrived at the course early with the intention of having a sauna to lose weight, only to find the sauna had not been available to use on the day. However, the committee on the day indicated any further breach of the rule would lead to a suspension.

Because this was Mr Lammas' fifth charge in a short period he was seeking a suspension of 4/5 days. He said Mr Lammas was a national rider and any suspension should reflect that.

Mr Lammas accepted he had failed to make the contracted weight. He stated he was a busy rider, booking between 6-8 rides on most days. He had confirmed rides at Te Aroha on the 15th July. He was not seeking a deferment of a suspension but felt three days suspension was preferable.   

Reasons for Penalty:

The committee believed a starting point of five days suspension was appropriate. Credit of one day was given for Mr Lammas’ early admission of the breach. The committee is concerned that this was Mr Lammas fifth charge under this rule since March this year. Also on this occasion a replacement rider had to be found at short notice.

Taking all those factors into account a suspension of four days is appropriate.
