As Ms Wynne admitted the breach the charge was found proved.

Penalty:

Ms Wynne is suspended for 7 riding days from the end of racing on 13th October 2019 to the close of racing on the 24th October 2019.

Facts:

Following the running of Race 6 the “Murry Groundwater@ L J Hooker Group 1200” an Information was filed by Stipendiary Steward, Mr M Davidson, against Licenced Jockey Ms S Wynne in that “she allowed (MEDITERRANEAN STAR) to shift in near the 950 metres when not clear of (MEARA MARY) S Weatherley who clipped a heel and blundered ”.

Rule 638(1)(d) reads as follows:

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless”

Ms Wynne had indicated on the Information that this breach of the Rules was admitted and she confirmed this at the hearing. Ms Wynne also agreed that she understood the charge and the Rule it was brought under.

Mr Davidson with the assistance of Mr Coles used video coverage to show approaching the 950m Ms Wynne who was racing one off the rail cross Mr Weatherley to the lead when she had just barely a length advantage. Mr Coles pointed to the resulting check and blunder of Mr Weatherley’s mount and said it was clearly a misjudgement by Ms Wynne.

Ms Wynne said Mr Weatherley had communicated to her to take the front but had gone with her more than she had anticipated but accepted it was her responsibility to be clear.

Submissions for Penalty:

Mr Davidson said Ms Wynne had just returned to race riding from injury and had a good record. He said the Stewards assessed the breach as mid-range.

Reasons for Penalty:

The JCA Penalty Guide provides a starting point of an 8-day suspension for a mid-range breach of this rule. Ms Wynne has her admission and good record as mitigating factors and is without any relevant aggravating factors for the Committee to consider.

With regard to the above the Committee considered a 7-day suspension is an appropriate penalty in this case.

Ms Wynne said a deferment was not required.
