Decision:
Mr Mo admitted a breach of R 638(1)(d) in that being the rider of GOVERNOR BAY, shortly after the start he allowed his mount to shift in when not clear dictating URBAN GOSSIP down on to GROOVE ASSASSIN, who was checked, and then further on to LONELY GEORGE, who clipped a heel. We thus find the charge proved.

--We have viewed the videos head on and side on. Mr Mo has allowed his mount to move inwards for a stride or 2 too far with consequential tightening to Mr Moseley and Mr Johnson, with Ms Morris ultimately clipping heels. Both Mr Williams and the stipendiary steward agree that the initial movement was from PIONEER PUPIL on Mr Mo’s outer. However, that pressure was released and Mr Mo continued his inwards movement. As Mr Davidson said, Mo kept the pressure on for a stride or 2 too long.
--Mr Mo has an excellent record of no breaches of this Rule, although this is tempered by the fact he has only been riding in New Zealand for 2 1/2 months. He rode his first winner today. We understand he has ridden 13 winners in Australia. We also give credit for his ready admission of the breach in circumstances where he could have endeavoured to lay blame with the jockey racing on his outer.
--Mr Davidson described the breach as mid range and asked for 4 to 5 days. We see the breach to be at the lower end of mid range having regard to the influence of the horse on Mr Mo’s outer, and adopt a starting point of 4 days. We give credit for Mr Mo’s excellent record, his admission of the breach, and the fact that the next 3 days of racing in the South Island are premier days. Significantly, these are 3 of the only 4 premier days in the South Island. This leads us to reduce the period of suspension to 2 days. We emphasise this is the first breach by Mr Mo of any of NZTR’s Rules. Accordingly, he has been afforded some leniency. Mr Mo must learn from this experience of his “being in the room” and we remind him of his responsibilities to fellow jockeys. This decision is tailored to the particular facts of this case and should not be seen to establish a precedent.
--Mr Mo is suspended from the end of racing on 3 November up to and including 11 November. This is 2 South Island days.
