Following the running of the running of Race # 2 the OPHI VINEYARD & PORT FM MAIDEN 1200 Stipendiary Steward Mr M Zarb filed an Information “...alleging that R Hannam, the rider of TRUTH placed 4th by the judge, failed to weigh-in...”
Rule 647 (1) provides as follows:
All riders in a Race shall weigh-in, unless excused from doing so by a Stipendiary Steward. A horse rider who does not weigh-in shall, in addition to any other penalty which may be imposed, be disqualified from the Race, unless the Stipendiary Stewards are satisfied:
(a) Rider’s failure to weigh-in, in accordance with this Rule, was justified by extraordinary circumstances, including if the Stipendiary Stewards are satisfied that, on account of accident or sudden illness, it is impracticable for him to weigh-in.
(b) Rider weighed out correctly with, and carried, his proper weight.
Submissions for Decision:
Both Mr Zarb and Mr Hannam agreed the evidence given in the previous hearing for a Ruling be accepted. No new evidence was provided by either party.
Submissions for Penalty:
Mr Zarb said Mr Hannam had never appeared before the stewards or a committee on a similar charge in his riding career. He did not believe a suspension was warranted under the circumstances. He was seeking a fine in the range of $500 to $1,000.
Mr Hannam said weighing-in was his responsibility and accepted he was at fault. He said there was nothing malicious on his part and it was the first charge of this Rule in his long riding career.
Reasons for Penalty:
The committee took into account Mr Hannam’s admission of the charge and his excellent record under this Rule. The committee also took into account the status of the race, maiden, and that the disqualification affected a fourth placed dividend. The committee believed a fine was the appropriate penalty.
