Facts:

Mr Allison, Stipendiary Steward, alleged that in race 1 the BISHOPDALE & BUSH INN TAB’S/TAVERN HAREWOOD AMATEUR DRIVERS MOBILE PACE, GLACIER EXPRESS (Mr R Sissons) shifted ground outwards near the 400 metre mark checking ROCK OF TARA (Mr A White).

Rule 869(8) states:
The Judicial Committee may in addition to any other penalty which may be imposed pursuant to r 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

Submissions for Decision:

Mr Allison demonstrated on two video angles that on the home bend Mr Sissons, who was trailing SUPREME ESTELLA, moved wider on the track and forced Mr White, who was racing outside him to take hold of his horse ROCK OF TARA on two occasions. He explained and demonstrated that Mr White was unable to move wider on the track as Ms Blake was racing outside him. The result of this movement was that Mr White was checked and lost in total, he estimated, some two lengths, and more particularly, his rightful position on the track. He demonstrated Mr White was blocked for room and had to switch ground a number of times before making ground in the run home towards the inside of the track.

Mr White gave evidence that he was two wide following his stable-mate when Mr Sissons started to come out. He said he called out that there was a horse on his outside and not to come out. He said he had to check out of the gap, briefly locked wheels with Ms Blake and, when he got back in, Mr Sissons got him again. He was confident that the interference he suffered was the consequence of movement from his inside and not from his outer.

Ms Blake stated she was racing outside and ahead of Mr White. When questioned whether Mr White had room when racing on the home bend, she said he did not. She also said she was aware that the inside wheel of her cart and that of Mr White had locked briefly.

Mr Sissons acknowledged that he had tightened Mr White and that ROCK OF TARA had skipped, he thought, for a stride. He accepted this was his fault. However, he did not believe Mr White was hard up on the back of his stable-mate. He believed he was back half a length when he came out the first time and full length the second time. He said he was aware Mr White was yelling to be given room and he had waited before coming out. He emphasised that Mr White had not maintained his position; therefore, he was entitled to come out. He added ROCK OF TARA was not going well enough and was losing ground at the time.

Reasons for Decision:

We are satisfied that Mr Sissons has moved wider on the track at a time he was not entitled to come out. Mr White was racing on his outside and Ms Blake was outside and slightly ahead of Mr White. There was thus nowhere for Mr White to go and he had to check his horse on two occasions. As a consequence he lost both ground and his position in the field. When Mr White eventually found room in the home straight ROCK OF TARA finished on quite strongly to finish 7th.

ROCK OF TARA has suffered interference as a consequence of outwards movement from GLACIER EXPRESS. As the progress and chances of ROCK OF TARA were clearly affected, we exercise our discretion and GLACIER EXPRESS is relegated to behind ROCK OF TARA.
