Mr Shand you’ve admitted a breach of rule 869(2)(a), excessive use of the whip, when driving MIGHTY MEMORIES over the final stages of race 9. We thus find the charge proved.

Mr Allison has demonstrated on the video that the whip was used continuously from before you turned for home. He has said that there were some 24 strikes with the whip.
----
You acknowledge this count is correct but state that those strikes before the run in the straight were on the shaft of the sulky not the horse. You state the horse had “knocked off” at the corner and that was when you started to hit the horse rather than the cart. You also emphasise that you had only recently been found to have failed to drive your horse out to the finish and that was why you kept hitting MIGHTY MEMORIES right to the line.

Mr Allison has asked for a fine at the lower end. We take into account your ready admission of the breach and your excellent record with respect to this rule. You state you have never been charged previously under this rule and Mr Allison does not dispute this. We believe the matter can be dealt with by way of a fine and we fine you the sum of $200.
