Following race 3 an information was filed pursuant to Rule 876(1) when it was alleged by the informant, Mr K O?Connor, trainer of the third horse WILLIE WINIT, that the first horse PROPOSITION interfered with his horse's chance

DECISION & REASON:
--Following race 3 an information was filed pursuant to Rule 876(1) when it was alleged by the informant, Mr K O?Connor, trainer of the third horse WILLIE WINIT, that the first horse PROPOSITION interfered with his horse's chance in the final straight. The official margins were a nose between first and second, and 2 lengths between second and third.
----All connections were informed of the protest.
----Present at the inquiry were:
--WILLE WINIT ? trainer and owner Mr K O?Connor and jockey Mr P Boylan.
--PROPOSITION ? trainer Mr B Foote, owner Mr G Sherratt and jockey Mr N Hanley.
----Mr O?Connor demonstrated the video films and showed when the winner PROPOSITION had jumped out at the last fence into the line of WILLIE WINIT. He also said that shortly afterwards PROPOSITION came out again causing Mr Hanley to stop riding. He said it cost his horse more than 2 lengths.
----Mr Hanley, rider of WILLIE WINIT, said he lost a length at the fence when PROPOSITION jumped outwards and further on there was little room to come through because of the outward movement of PROPOSITION.
----Mr B Foote, trainer of PROPOSITION, admitted his horse jumped out but the further outward movement did not cause WILLIE WINIT a better placing.
----Mr P Boylan, rider of PROPOSITION, said his horse was getting tired and was lugging out. He agreed with Mr Foote that the placings were not affected.
----Mr G Sherratt, owner of PROPOSITION, confirmed what the trainer and rider had said.
----Mr J Oatham, Stipendiary Steward, agreed that PROPOSITION did jump out at the last fence and continued some outward movement afterwards. However, Mr Hanley had only taken hold in the concluding stages and with the 2 length margin between second and third Mr Oatham was in doubt as to whether placings were affected.
----The Committee carefully considered all evidence after reviewing the video films. While WILLIE WINIT did receive some inconvenience from PROPOSITION at the last fence and closer to the post, we are clearly of the opinion that it was insufficient movement to affect the chances of WILLIE WINIT finishing in a better placing. In reaching this decision the 2 length margin between second and third was very relevant and also the manner in which both the second and third horses were finishing. Accordingly the protest is dismissed and the Judge's placings shall stand.
