Following race 2 an information was filed pursuant to rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J P Oatham, that Miss Fleming shifted inwards after the start when not sufficiently clear

DECISION & REASON:

Following race 2 an information was filed pursuant to rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J P Oatham, that Miss Fleming shifted inwards after the start when not sufficiently clear causing interference to MAJESTIC DANCER (A Peard), YOUAREMYSUNSHINE (M Innes), OUR PROMISE (R Allwood) and HAPPY DEVIL (K Davidson). Miss Fleming admitted the charge.

Mr Robinson demonstrated the video which clearly showed Miss Fleming, soon after the start, let her mount move inwards towards the running rail and hinder the horses inside of her.

Miss Fleming said that it was her first race ride for 11 months and obviously she was a bit rusty.

PENALTY:

Mr Oatham said this was a little unusual because there was no evidence that Miss Fleming was riding regularly and he therefore asked for a suspension plus a fine of $300 - $500.

When questioned Miss Fleming said she had no confirmed rides although the local trainers had indicated they would be giving her some.

the Committee suspended her from the completion of racing on 29 December until the completion of racing on 3 January 2006. Because Miss Fleming's riding commitments are intermittent we also impose a fine of $400.
