Following Race 10 an information was lodged pursuant to Rule 876(1) alleging interference by MAXIMABEEL placed second by the judge, to MYSTERY CREEK placed fourth by the judge.

DECISION AND REASON:
--Following Race 10 an information was lodged pursuant to Rule 876(1) alleging interference by MAXIMABEEL placed second by the judge, to MYSTERY CREEK placed fourth by the judge. The margin between the third and fourth placed horses was a neck.
--Mr Coles reserved the right to charge Mr C Lammas.
--Mr Robinson demonstrated both video films, which clearly showed MAXIMABEEL, move in approximately three horse widths in the straight and in the process cause interference to MYSTERY CREEK ridden by Mr N Harris on two occasions.
--Neither Mr Brosnan, trainer of MAXIMABEEL, or rider Mr C Lammas, when given the opportunity, offered any defence.
--Mr Coles said the Mr Harris was stopped on two occasions which certainly cost him ground.
--The committee carefully considered all evidence and has no doubt that interference was suffered by Mr Harris when MAXIMABEEL moved in three horse widths.
--We then considered whether MYSTERY CREEK would have finished in a better place. Taking into account the neck margin between third and fourth and the strong manner in which MYSTERY CREEK recovered and went to the line we have no doubt that his chances of finishing in a better place were affected. Accordingly the protest is upheld and the placings shall now be ?
